The Department of Marine Resources (DMR) is holding a lease revocation hearing for the site listed below. Please carefully review the following information as there are important deadlines governing participation.

PURPOSE OF THE HEARING: DMR is initiating this lease revocation proceeding in accordance with 12 M.R.S.A. § 6072(11), on the grounds that the lease holder has:

  • Failed to maintain minimum lease maintenance standards as specified in Chapter 2.75 of DMR’s regulations;

  • Violated one or more lease conditions; and,

  • Defaulted on the lease agreement.

AUTHORITY AND JURISDICTION: DMR is conducting this revocation proceeding pursuant to its authority under 12 M.R.S.A. § 6072(11).

What is a revocation proceeding?

DMR may initiate a lease revocation hearing for a standard lease in accordance with 12 M.R.S.A. §6072(11) and provisions of the lease agreement. These proceedings are invoked when DMR determines one or more of the following apply to the operation of the specific site:

  • Aquaculture has been conducted in a manner substantially injurious to marine organisms or public health;

  • No substantial aquaculture or research has been conducted over the course of the lease;

  • Any lease condition of the lease has been violated, or any minimum lease maintenance standard has been violated;

  • The lease holder has defaulted on their lease agreement.

Testimony should be specific to one or more of the points above as it relates to the operation of the lease site in question.
