X-Ray Licensing

The Maine Radiation Control Program X-ray section is staffed by Bob Stilwell and Dan Quesada. The x-ray section registers approximately 1100 x-ray facilities. There is an annual registration fee per x-ray machine and a requirement for periodic inspections. These inspections are performed by third party qualified experts who are approved by the agency.

Mammographic facilities are inspected annually by the State for compliance with the Mammography Quality Standards Act. There are 59 registered diagnostic mammographic facilities in Maine.

Clinic/Private Office Facility in Maine

To open a new or add an additional x-ray unit at an x-ray facility in a private office or clinic in the State of Maine, each owner of the x-ray facility must:

  1. Have a shielding design (a drawing of the purposed x-ray facility indicating what shielding material is required) performed by a Qualified expert, (PDF) If this is a replacement x-ray unit used in the same facility in the same room, please fill out the form HHE804A (PDF) and get it signed by your Qualified expert. (PDF)
  2. Submit the shielding design to the Radiation Control Program for review. Send to Radiation.DHHS@Maine.gov
  3. Complete and submit to the Radiation Control Program the registration form with the proper registration fee. Use form HHE 804 (PDF) for fee submission and form HHE 805 (PDF) for (each) x-ray machine data.
  4. Have the x-ray equipment inspected by a Qualified expert (PDF) within 30 days of installation and every 2 years. A copy of this report must be sent to the Radiation Control Program, any areas of non-compliance must be repaired/adjusted within 60 days and a copy of the service representative's report sent to the Radiation Control Program (Radiation.DHHS@Maine.gov) and
  5. Have a Quality Assurance Program and perform the necessary test to assure good quality.
Requirements For Dental Facility In Maine

To open a Dental x-ray facility or add an additional x-ray unit in the State of Maine, each owner of the x-ray facility must:

  1. Have a shielding design (a drawing of the purposed x-ray facility indicating what shielding material is required) performed by a Qualified expert, (PDF) If this is a replacement x-ray unit used in the same facility in the same room, please fill out the form HHE804A (PDF) and get it signed by your qualified expert (PDF) and you may not need to get another shielding design done.
  2. Submit the shielding design to the Radiation Control Program for review. Send to Radiation.DHHS@Maine.gov
  3. Complete and submit to the Radiation Control Program the registration form with the proper registration fee. Use form HHE 804 (PDF) for fee submission and form HHE 805 (PDF) for (each) x-ray machine data.
  4. Have the x-ray equipment inspected by a qualified expert within a year of installation and every 3 years thereafter. A copy of this inspection report must be sent to the Radiation Control Program, any areas of non-compliance must be repaired/adjusted within 60 days and a copy of the service representative's report sent to the Radiation Control Program.
  5. Post safety rules at the control panel.
Requirements For Podiatric Facility In Maine

To open or to move an existing podiatric x-ray facility in the State of Maine each owner of the x-ray unit must:

  1. Have a shielding design (a drawing of the purposed x-ray facility indicating what shielding material is required) performed by a Qualified expert, (PDF) If this is a replacement x-ray unit used in the same facility in the same room, please fill out the form HHE804A (PDF)and get it signed by your Qualified expert (PDF).
  2. Submit the shielding design to the Radiation Control Program for review. Send to Radiation.DHHS@Maine.gov
  3. Complete and submit to the Radiation Control Program the registration form with the proper registration fee. Use form HHE 804 (PDF) for fee submission and form HHE 805 (PDF) for (each) x-ray machine data.
  4. Have the x-ray equipment inspected by a qualified expert within 12 month of installation and every 3 years thereafter. A copy of this inspection report must be sent to the Radiation Control Program, any areas of non-compliance must be repaired/adjusted within 60 days and a copy of the service representative's report sent to the Radiation Control Program.   5. Have a Quality Assurance Program and perform the necessary test to assure good quality.
Requirements For Chiropractic Facility In Maine

To open, to add an additional unit or move existing x-ray equipment in the State of Maine, each owner of the x-ray facility must:

  1. Have a shielding design (a drawing of the purposed x-ray facility indicating what shielding material is required) performed by a Qualified expert, (PDF) If this is a replacement x-ray unit used in the same facility in the same room, please fill out the form HHE804A (PDF)and get it signed by your Qualified expert (PDF).
  2. Submit the shielding design to the Radiation Control Program for review. Send to Radiation.DHHS@Maine.gov
  3. Complete and submit to the Radiation Control Program the registration form with the proper registration fee. Use form HHE 804 (PDF) for fee submission and form HHE 805 (PDF) for (each) x-ray machine data.
  4. Have the x-ray equipment inspected by a qualified expert within 30 days of installation and every 2 years. A copy of this report must be sent to the Radiation Control Program, any areas of non-compliance must be repaired/adjusted within 60 days and a copy of the service representative's report sent to the Radiation Control Program and
  5. Have a Quality Assurance Program and perform the necessary test to assure good quality.
Requirements For Bringing An Industrial X-Ray Unit Into Maine

Before bringing the x-ray unit into the State of Maine each owner/user must:

  1. Complete and submit to the Radiation Control Program the registration form with the proper registration fee. Use form HHE 804 (PDF) for fee submission and form HHE 805 (PDF) for (each) x-ray machine data.
  2. Inform the Radiation Control Program where the unit will be used and how long the unit will be in Maine,
  3. Have the x-ray equipment inspected by a qualified expert within 30 days of entering the state. A copy of this report must be sent to the Radiation Control Program, any areas of non-compliance must be repaired/adjusted within 60 days and a copy of the service representative's report sent to the Radiation Control Program.
  4. If the unit is to be used for less than 30 days in Maine, an inspection report performed by an outside inspector must be submitted to the Radiation Control Program.
Requirements For Veterinary Facility In Maine

To open a new facility or add an additional x-ray machine at a Veterinary facility in the State of Maine, each owner of the x-ray unit must:

  1. Have a shielding design (a drawing of the purposed x-ray facility indicating what shielding material is required) performed by a Qualified expert, (PDF) If this is a replacement x-ray unit used in the same facility in the same room, please fill out the form HHE804A (PDF) and get it signed by your Qualified expert (PDF).
  2. Submit the shielding design to the Radiation Control Program for review. Send to Radiation.DHHS@Maine.gov
  3. Complete and submit to the Radiation Control Program the registration form with the proper registration fee. Use form HHE 804 (PDF) for fee submission and form HHE 805 (PDF) for (each) x-ray machine data.
  4. Have the x-ray equipment inspected by a qualified expertwithin 30 days of installation and every 5 years. A copy of this report must be sent to the Radiation Control Program, any areas of non-compliance must be repaired/adjusted within 60 days and a copy of the service representative's report sent to the Radiation Control Program (Radiation.DHHS@maine.gov).
Register Your Out-of-State Radiation Machine
  1. Whenever any radiation machine is to be brought into Maine, for any temporary use, the person proposing to bring such machine into the sate shall give written notice to the Maine CDC at least 2 working days before such machine is to be used in the state. The notice shall include:
    1. the type of radiation machine
    2. the nature, duration, and scope of use
    3. the exact location(s) where the radiation machine is to be used, and
    4. the states in which this machine is registered.
  2. If, for a specific case, the 2 working-day period would impose an undue hardship on the person, upon notification to the agency, permission to proceed sooner may be granted.
  3. The person referred to in (1) shall:
    1. comply with all applicable regulations of the agency, to include the necessary inspection and registration fees,
    2. supply the agency with such other information as the agency may reasonably request, and
    3. not operate within the state on a temporary basis in excess of 90 calendar days per year.
Requirements For Mobile X-Ray Service In Maine

To provide a mobile x-ray service to the State of Maine each owner of the x-ray service must:

  1. Submit to Radiation Control Program list of Technologist and Radiologist and copies of their state licenses and credentials employed by the service,
  2. Submit to the Radiation Control Program a list of sites where mobile unit will be used,
  3. Complete and submit to the Radiation Control Program the registration forms with the proper registration fee. Use form HHE 804 (PDF) for fee submission and form HHE 805 (PDF) for (each) x-ray machine data.
  4. Have the x-ray equipment inspected by a qualified expert before unit is used in the State of Maine and every 2 years. A copy of this report must be sent to the Radiation Control Program, any areas of non-compliance must be repaired/adjusted within 60 days and a copy of the service representative's report sent to the Radiation Control Program.
