RPS Petition Requirements
Chapter 311 of the Commission’s Rules outlines the Maine Class I, Class IA, and Thermal REC certification process, including information required to include in a petition for RPS certification (see Chapter 311) .
A complete petition must include all information necessary to determine eligibility.
Petitions must be submitted through the Commission’s electronic Case Management System (CMS).
Class I and Class IA
As stated in Chapter 311, § 3(C)(2)., the Petition for certification shall include:
- Name and full address of petitioner
- Please also include the name, email, and phone number of the individual responsible for the petition.
- Please also include the name, email, and phone number of the individual responsible for the petition.
- Location of the generation facility
- For land-based facilities, provide the full address.
- For off-shore facilities, provide the geocoordinates and location of interconnection;
- Description of the generation facility, including:
- fuel type,
- nameplate capacity and
- initial commercial operation date;
- Demonstration of qualification for a comparable portfolio requirement in another state, if applicable (provide documentation as an attachment to the petition);
- The new renewable capacity resource category for which certification is sought (as defined in Chapter 311 § 2(T));
- If certification is sought for a facility added to an existing facility:
- Historical output and means to determine incremental output;
- Historical output and means to determine incremental output;
- If certification is sought under resumed operations:
- the time period for which the facility did not operate,
- the reasons the facility did not operate and
- the date operation resumed;
- If certification is sought under refurbishment,
- a description of facility refurbishment including the time period over which they were performed and the amount of capital expenditure,
- a statement of the previous useful life of the facility and the degree to which the useful life has been extended,
- the use of an alternate technology and resulting efficiency increases; and
- Any other information that the Commission determines to be necessary or useful.
In addition, the Commission requires the following information:
- The NEPOOL GIS or NAR Generator ID number.
- Will this facility serve load “behind-the-meter” (BTM)?
- Will the facility be providing kilowatt-hour (kWh) credits under Maine’s Net Energy Billing (NEB) Kilowatt-Hour Credit Program?
- If the facility is a hydroelectric facility, documentation of compliance with all state and federal fish passage requirements.
Thermal REC
As stated in Chapter 311, § 5(B)(2)., the Petition for certification shall include:
- Name and address of petitioner;
- Location of the thermal energy facility;
- Location of the end user entity;
- Description of the thermal energy facility, including form of thermal energy and a means to verify the use of the form of thermal energy;
- The initial commercial operations date, including verification of the commercial operations date;
- The means by which the thermal energy will be delivered to the end user and the metering or other means certified by the commission necessary to validate the thermal energy generated and transmitted;
- A demonstration and a means for verification that the thermal energy will be used for heating, cooling, humidity control, process use or other end use to meet a need of the end user that would otherwise be met using another energy source such as electricity or an on-site thermal energy system;
- A demonstration that the thermal energy facility meets any existing efficiency standards in effect for the sale or installation of the facility or, if no efficiency standards exist, a showing as to the facility’s efficiency;
- A demonstration and a means for verification that the thermal energy will be generated with any efficiency standards established by the Commission in this section;
- Demonstration of qualification for a comparable portfolio requirement in another state, if applicable;
- Any other information that the Commission determines to be necessary or useful.
In addition, The Commission requires answers for the following questions:
- What is the NEPOOL GIS or NAR Generator ID number?
- Will this facility also produce electric RECs?
