Civil Rights Office

The MaineDOT Civil Rights Office is responsible for ensuring compliance with anti-discrimination, Equal Employment Opportunity (EEO), and labor law requirements for all federal-aid funded road and bridge construction projects. The Civil Rights Office also ensures that no person in the State of Maine is excluded from participation in, denied the benefits of, or be otherwise subjected to discrimination based on race, color, religion, sex, national origin, age, or disability under any program administered by the Maine Department of Transportation.

The Civil Rights Office seeks to create workforce continuity and bolster long-term employment and retention of traditionally under represented individuals in the area of non-traditional trades in road and bridge construction. The Civil Rights Office will collaborate with contractors and area agencies to pursue worker placement at MaineDOT administered construction projects, funded by U.S. DOT, and to mitigate harassment, intimidation, and discrimination from the workplace.

On-the-Job Training (OJT) and Supportive Services Programs

OJT Program

The OJT Program works with statewide contractors to provide meaningful training and employment opportunities for underrepresented individuals on federal-aid highway & bridge projects. The main objective is for all qualified candidates to train a required amount of hours (usually 1,000 hours) to achieve full journey status.

On-the-Job Training is required at qualifying federal-aid funded projects over a certain dollar amount with the MaineDOT. MaineDOT will determine which projects are suitable for OJT training hours. The training hours are included on the Schedule of Items in project bid documents.

OJT Supportive Services

The Civil Rights Office of MaineDOT collaborates with Maine area agencies to provide various trainings for those interested in non-traditional trades leading to potential highway and bridge construction employment. Such trainings that have been offered in the past include CDL Class B truck driver's license, introductory welding, OSHA, etc. If you are interested in supportive services, please fill out the OJT Application

Davis-Bacon & Related Acts - Labor Compliance

Davis Bacon & Related Acts

For all federal-aid funded construction projects, the Maine Department of Transportation requires all contractors and subcontractors to utilize the Davis Bacon & Related Acts to ensure that prevailing wages are paid to all laborers and mechanics. In order to track prevailing wage data and certified payroll, MaineDOT implemented the use of Elation Systems software program in 2009. 

All contractors and subcontractors performing work at federal-aid funded construction projects must use Elation Systems for certified payroll documentation, prompt payments to and from contractors, and tracking yearly EEO data as required by the Department of Labor.

Equal Employment Opportunity/Contractor Compliance

The foundation for the Equal Employment Opportunity policy is derived from state and federal laws and regulations, as well as a moral and professional commitment.

As a recipient of federal funding, it is incumbent upon MaineDOT to ensure that contracts awarded through our agency adhere to the standards prescribed by federal and state law. The Civil Rights Office is responsible for ensuring that federal and state EEO laws are complied with on each project.

Contractors and subcontractors must follow the FHWA Contractor Compliance Program to ensure all EEO requirements are being met and enforced. Each year, Contractor Compliance reviews are conducted at random with various contractors and subcontractors to ensure all rules and regulations are followed. The MaineDOT Civil Rights Office will conduct interviews with integral contractor staff and provide guidance, as requested.

Federal General Decision Wage Rates

Project Specific Classification (Wage Rate) Requests

Periodically, a federally funded project will require a laborer classification that is not listed on the general decision(s). In case this happens, the contractor or subcontractor must submit a Project Specific Classification (or wage rate) request through Elation. The US Department of Labor will only accept the requests through Elation. No paper requested will be accepted. The Civil Rights Office will review such requests prior to submission to the U.S. Department of Labor.
