Attention: Section 28 Electronic Visit Verification (EVV) Providers, CR 117818

Earlier this year, the Department made changes to Section 28 rates and modifier combinations as a result of recent rate studies conducted in relation to P.L. 2021 Ch. 398, Pt. AAAA; Ch. 635, Pt JJJ; and Ch. 639. These changes included allowing providers of Section 28 services to use the U1 modifier with procedure code H2021. Claims with this code/modifier combination are subject to EVV requirements; however, due to a delay in EVV-related systems implementation, providers have been unable to create corresponding visit records for members receiving these approved in-home services.   

This issue is now corrected, and providers can submit EVV related claims with the code/modifier combination H2021/U1. We apologize for the inconvenience.
