Flame Retardants in Furniture

Flame retardants are prohibited in new upholstered residential furniture sold in Maine.

Maine law prohibits the use of any chemical flame retardant in new upholstered furniture sold in Maine. This means that new upholstered residential furniture sold in Maine cannot contain any chemical flame retardant in an amount greater than 0.1% or 0.1% of a mixture.

This law applies to anyone selling new upholstered residential furniture after January 1, 2019.

Used upholstered furniture and upholstered furniture in public facilities are exempt from this law.

The Department will be developing rules to further explain how this law will be implemented. Please check Department Rulemaking Proposals for information and to sign up for notification of rule making activity associated with this program.
