Proposed Rules

The Office of Cannabis Policy (OCP) is engaging in routine technical rulemaking to make changes to the Rules for the Certification of Cannabis Testing Facilities, 18-691 CMR, ch. 5 and Rules for the Testing of Adult Use Cannabis, 18-691 CMR, ch. 40. 

    Please use the links below to access the proposed rules and public comment forms. All public comments must be submitted to OCP by Friday, August, 14, 2026 at 5:00 p.m.  Additional instructions are available here.


    Rules for the Certification of Cannabis Testing Facilities, 18-691 CMR, Chapter 5

    • Use this form to submit public comment on the proposed Chapter 5 rulemaking
    • Summary of changes: 
      • Defines often-used but previously undefined terminology;
      • Clarifies the annual assessment process;
      • Clarifies the requirements applicable to quality control, standard operating procedures, chain of custody records, and sample rejection;
      • Requires that samples not meeting acceptance criteria be rejected by the cannabis testing facility that received it; and
      • Updates the mandatory testing requirements applicable to edible cannabis products.

    Rules for the Testing of Adult Use Cannabis, 18-691 CMR, Chapter 40

    • Use this form to submit public comment on the proposed Chapter 40 rulemaking
    • Summary of changes:
      • Incorporates changes to the laws regarding mandatory testing of edible cannabis products;
      • Clarifies what tests are required for cannabis and cannabis products in final form;
      • Clarifies the requirements applicable to retests for potency; and
      • Updates the standard operating procedure that must be used by all adult use cannabis program participants collecting, handling, transporting, and receiving samples of cannabis or cannabis products for mandatory testing.
