The Maine Labor Relations Board conducts mail-ballot elections to determine whether the employees in the bargaining unit wish to be represented for the purposes of collective bargaining. As provided in 26 MRSA section 967 (2), an organization will not be certified as the bargaining agent unless it receives the majority of votes of those voting. The bargaining agent certified as representing a bargaining unit shall be recognized by the public employer as the sole and exclusive bargaining agent for all of the employees in the bargaining unit unless the employees subsequently petition the MLRB for a new election and elect a different bargaining agent or elect to have no representative.
