Unit Agreement
When the employer and union have agreed upon the composition of the employees in a bargaining unit or have agreed upon a change in the composition of the unit, an Agreement on Appropriate Unit form is used. To file a unit agreement with the Maine Labor Relations Board, please follow these steps:
- Review the MLRB Rules which govern the filing of unit clarification petitions – see Chapter 11, Section 3 of the MLRB Rules (PDF).
- Complete and sign MLRB Form 1 (PDF), Agreement on Appropriate Unit, in accordance with the rules.
- E-file (PDF) the petition by emailing a copy to mlrb@maine.gov.
Once the agreement form is filed, the Executive Director will issue a Notice to Employees that must be distributed or posted by the employer. Please see Chapter 11, Sections 3 and 15 of the MLRB Rules (PDF) for more information.
Voluntary Recognition
When the employer voluntarily recognizes a bargaining agent as the representative of employees in a bargaining unit a Voluntary Recognition form is used. To file a voluntary recognition with the Maine Labor Relations Board, please follow these steps:
- Review the MLRB Rules which govern the filing of unit clarification petitions – see Chapter 11, Section 3 of the MLRB Rules (PDF).
- Complete and sign MLRB Form 3 (PDF), Voluntary Recognition, in accordance with the rules.
- E-file (PDF) the petition by emailing a copy to mlrb@maine.gov.
