Personal Appointments

Personal appointments do not require a public hearing or approval of the State Legislature. Persons appointed to Personal Boards must be sworn in by a Dedimus Justice within 30 days of their appointment. If the appointee is not sworn in within 30 days, they may not serve until they are reappointed by the Governor. The following fall under the category of Personal Boards:

Personal appointments may be further categorized into the following groups:

1. Advisory Boards: Persons appointed to an advisory board do not have to take an oath of office before a Dedimus Justice, they are automatically qualified upon appointment. All other "non advisory" boards require an appointee to be sworn in prior to serving in their official capacity. A board is deemed "advisory" by Maine State Statute Title 5 M.R.S.A. § 12012: "A board is solely advisory in authority if its only authority is to review policies and procedures, conduct studies, or advise or make recommendations to a branch of government. It may not have the authority to control expenditures, issue rules, approve decisions of other agencies or officials or enforce its decisions or recommendations." Those boards that are considered "advisory" may so be identified by careful consideration of the enabling statute.


2. Federal Boards: Federal boards are those created by federal statute and to which the governor must make one or more appointments. The following fall under the category of Federal Boards:

3. Licensing and Regulatory Boards: These boards are administered by the Department of Professional and Financial Regulation. Licensing boards exist to protect the public's health, safety and welfare through the regulation of various professions. Such protections are enforced through both the licensing of individuals who demonstrate a standard of competency in a regulated profession and also through licensure laws against fraudulent, incompetent and unethical practices. Each state licensing board is comprised primarily of members of the profession or occupation that it regulates. Every board also includes at least one public member. Public members are not expected to have a technical expertise or experience in the licensed professions of the boards on which they serve.
