Note:  Due to COVID-19 precautions, the Commission’s office is not open to the public.  The meeting was conducted through Zoom video conferencing and streamed to YouTube for the public to access. 

1.  Legal Objections to Subpoena for Documents – Investigation of Stop the Corridor

The Commission will continue its consideration of agenda item #2 from the Commission’s June 11, 2021 meeting.  Stop the Corridor and a political consulting firm have objected to a second investigative subpoena to produce records.  The Commission will consider the objections as a petition to vacate or modify the subpoena under
5 M.R.S. § 9060(1)(C).  Part of the consideration of this item may be conducted in executive session pursuant to 1 M.R.S. § 405(6)(F) and 21-A M.R.S. § 1003(3-A).

Motion:  Pursuant to 1 MRSA § 405(6)(F) and 21-A MRSA § 1003(3-A), to go into executive session to consider the objections to the subpoena that was served.

Motion:  To modify the investigative subpoena served on Stop the Corridor to state that, regarding number 4, it be reworded to all documents discussing, describing, or otherwise showing the intended purposes or goals of any television advertising concerning NECEC transmitted during the period of November 1, 2019 to January 31, 2020 between Stop the Corridor, the entity allowed to remain confidential, and any other person, and that the Commission otherwise deny the objections made by Stop the Corridor to the subpoena that has been issued.
