The Department adopted amendments to 10-144 C.M.R. chapter 252 to incorporate Public Law 2025, chapter 408, which amended 22 M.R.S. § 1341 to explicitly permit certified Syringe Service Programs to operate mobile sites and provide delivery services in accordance with parameters set forth by Maine CDC. Rule amendments clarify that “Syringe Services” may be delivered to “Consumers” in person via “Brick and Mortar” and “Mobile” Sites, as well as hypodermic apparatus exchanges by delivery services, in accordance with 22 M.R.S. § 1341 (5). Under this rule, SSP delivery services of hypodermic apparatuses is limited to locations outside a 1,000-foot proximity from where there is a primary and secondary school. Following public comment on the proposed rule, the Department responded by making several changes to clarify definitions, data collection, and application requirements for SSP certification at establishment of the SSP and for any subsequent SSP modifications, including requirements for SSP to demonstrate notification to lead municipality officials, local or county law enforcement, and health care providers within the SSP areas of operations.
