Pursuant to its authority at 22 MRS § 264 (9), the Department is proposing this new rule to outline procedures for the Aging and Disability Mortality Review Panel. The Panel is established by Maine law to review deaths of, and serious injuries to, ‘adults receiving services’, defined as adults receiving home-based and community-based services under 42 Code of Federal Regulations, Part 441 and adults subject to public guardianship under Title 18‑C, Article 5, to identify factors contributing to the mortality of adults receiving services and strengths and weaknesses of the system of care. This rule describes the Panel’s authority and responsibilities, including managing conflicts of interest; collecting and using identifiable health information; participating in case reviews, conducting interviews; and making recommendations for improvements to the system for protecting adults receiving services
