SEBT – SUN Bucks Rule #1A

The Department adopts 10-144 C.M.R. Chapter 302; Summer Electronic Benefit Transfer Program Rules (SUN Bucks) consistent with 7 C.F.R. § 292.1. The adopted rules establish regulations under which the Department of Health and Human Services, Office for Family Independence will administer the Summer EBT (SEBT) Program as authorized by the U.S.D.A. – Food and Nutrition Services (F.N.S.) on April 25, 2025. The adopted rule changes are effective retroactive to April 25, 2025. Retroactive rulemaking is permissible under 22 M.R.S. § 42(8)(A) as the update is necessary to comply with federal requirements, provides a benefit to Summer Electronic Benefit Transfers (SEBT) – SUN Bucks recipients and does not adversely impact applicants, participants, beneficiaries, or providers.

In addition, the adopted rules implement the SEBT Program established for the purpose of providing nutrition assistance during the summer months for each eligible child, to ensure continued access to food when school is not in session for the summer.

This rule will not have an adverse impact on municipalities or small businesses.
