This rulemaking proposes to repeal and replace the current rule in force, 10-144 CMR Ch. 114, Rules Governing the Reporting of Sentinel Events. The proposed revisions will serve to bring the current rule in force into compliance with changes made to 22 M.R.S. Chapter 1684, Sentinel Events Reporting, as well as incorporate current National Quality Forum (NQF) standards for Serious Reportable Events.

Major proposed changes in this rulemaking include:

  • Updating the categories from the 2011 NQF list of Serious Reportable Events to incorporate the 2025 updated list.  This includes additional guidelines and updated resources;
  • Updating the definitions in the rule to align with current definitions drawn from the current NQF language and deleted definitions which were not used in the rule;
  • The definition of Healthcare Facility was modified to align with the definition in 22 M.R.S. § 8751;
  • Deleted the definition of “Sentinel Event”, and included those listed events in a new Section 2 (List of Sentinel Events);
  • Deleted Appendix A (National Quality Forum (NQF) 2011 List of Serious Reportable Events) as this list is included in the new Section 2 (List of Sentinel Events);
  • Added a new Section 2, which lists Sentinel Events which must be reported, and combines events listed in the current rule in: Appendix A, the definition of “Sentinel Event”, and Sec. 3.3.3 (Notification of Sexual Assault), into one section listing Sentinel Events;
  • Sec. 2(4) incorporates by reference the definition of terms as defined by the Joint Commission and National Quality Forum (NQF).  Aligning Patient Safety Reporting:  2025 Updates to Sentinel Events and Serious Reportable Events”  Washington, D.C.: NQF, 2026. 
  • Propose that the current Section 2 (Facility Responsibility”, now Section 3, be retitled:  “Health Care Facility Responsibilities” to better accord with 22 M.R.S. § 8751 et al. 
  • Sec. 6 (Confidential and Privileged Information): Proposed changes to this section in order to better comply with 22 M.R.S. § 8754(3). 
  • Section 5 (Consumer Complaints): Proposed changes to clarify that the consumer complaints may be complaints reporting a Sentinel Event.
