Qualifying Condition Review Process
Process Steps:
- Apply to the Maine Discharge Review Board (MDRB) using the Application for Restoration of Eligibility for State Veterans Benefits.
- The veteran works with a Maine Bureau of Veterans’ Services Veterans Services Officer to file an Application for Correction of Military Record, an Application for the Review of Discharge from the Armed Forces of the United States, and a VA claim.
- If applicable, the veteran may work with Pine Tree Legal’s Veterans’ Program to file
DD Form 293 – Application for the Review of Discharge from the Armed Forces of the United States. (Note: This service is part of Pine Tree Legal’s Veterans’ Program and Is income based; not all applicants may qualify.) - Upon successful review by the MDRB, the veteran will receive a written certificate verifying their upgraded discharge status for state law purposes.
- If the veteran receives an unsuccessful review by the MDRB they have the right to appeal the matter to the Maine Supreme Court.
Required Documents for Qualifying Condition Review Board:
- DD Form 214 - Discharge Papers and Separation Documents; and
- DD Form 149 - Application for Correction of Military Record; and/or
- DD Form 293 - Application for Review of Discharge from the Armed Forces of the United States; and
- Any relevant VA decision letters; and
- Veteran's Written Statement (not to exceed three, double-spaced typed pages in paragraph form using a standard 12-point font); and
- Supporting Documents (examples: medical records, awards, and letters of support)
