Independent Medical Examiner Program

The Workers' Compensation Board is looking for Section 312 Independent Medical Examiners with specialties in the following areas: Cardiology, Neurology, Orthopedic Surgery, Physiatry, and others. If interested, please submit an application.

Pursuant to Title 39-A M.R.S.A. § 312 and Board Rules Chapter 4, the Workers’ Compensation Board maintains a list of the most qualified and highly experienced health care providers to serve as independent medical examiners. A party may request an examination under § 312 by submitting a completed Request for Independent Medical Examination (M-2 form) to the Office of Medical/Rehabilitation Services. If the parties cannot agree on an examiner who meets the Board’s criteria, the Board shall assign one from its list of qualified examiners.

In a written report, the independent medical examiner will render medical findings relating to the medical condition of a claimant. The Board shall adopt the medical findings of the independent medical examiner unless there is clear and convincing evidence to the contrary in the record that does not support the medical findings.

39-A MRSA § 312 (2) specifies that an independent medical examiner selected and paid for by an employer to examine an employee in accordance with § 207 is limited to 12 such examinations per calendar year and shall notify the board of the name of the employee, the employer or the insurance company that requested the examination and the date of the examination within 10 days of the date of the examination.
