House advances Millett's bill to strengthen individualized education programs

AUGUSTA - The Maine House of Representatives gave its initial approval Wednesday to a measure sponsored by Rep. Rebecca Millett, D-Cape Elizabeth, that would strengthen individualized education programs (IEPs) for students.

LD 552, as amended, is designed to give parents a voice when material changes are being made to their child's IEP. Under current law, school districts are allowed to make changes to IEPs without the parents consent as long as the school provides a written notice of the changes. The bill directs the Maine Department of Education to amend its rules through major substantive rulemaking, involving all interested parties and stakeholders, and provide the Legislature with revised rules to later be voted on.

"This bill ensures best practices regarding IEPs are being implemented across the state, in every community, for every family and for every student," said Millett. "When I submitted this bill, my goal was to find a more workable solution so the needs of all parties are heard and a consensus is reached to do what is best for students. I am proud of the work the Education Committee put into this bill, and I am grateful to have support from my fellow representatives. It is time we give those who know their child best a voice in this very important process."

The changes proposed in LD 552 are not without precedent, as 12 other states currently require parental consent for some or all changes to an initial IEP. At least seven states, including Massachusetts and New Hampshire, can be described as "full consent states".

The bill will face further votes in the Senate in the coming days.

Millett is serving her first term in the Maine House and represents District 30, part of Cape Elizabeth. She sits on the Education and Cultural Affairs Committee. Prior to representing House District 30, Millett served eight years in the State Senate, representing District 29, which includes South Portland, Cape Elizabeth and part of Scarborough.
