RE: Reminder of Federal Regulatory
Requirements Not Restated in Maine Department of Education Reg. 180: Private Schools
Please take note of the following federal requirements (34 CFR §300.450 through 300.462) relating to the provision of FAPE to children in private schools that are not restated in Maine Department of Education Reg. 180, but which we are incorporating in Maine’s Part IDEA—Part B eligibility documents.
All CDS regional sites must comply with the federal IDEA regulatory requirements listed below. Additionally, these requirements will be added to the Agreement for all CDS Sites, which will assure by signature on the Approval Agreement, compliance with these requirements.
The U.S. Department of Education has asked that we remind you, by means of this Administrative Letter, of these requirements in order that you may ensure compliance with them. Two other Administrative Letters are also being sent to you: one that outlines miscellaneous requirements, and one that outlines federal requirements relating to insurance. Thus, you should receive three Administrative Letters.
