SUBJECT:       Amended Procedural Safeguards Notice

 

School administrative units were notified on July 30, 2003, via Administrative Letter #8, that the U.S. Department of Education, Office of Special Education Programs (OSEP), had determined the Procedural Safeguards Notice at Sec. 12.11 of Maine Special Education Regulation 101 did not include all of the language required under the federal regulation 34 CFR. 300.504.  OSEP articulated specific language that needed to be incorporated into the Procedural Safeguards Notice distributed to parents and guardians in accordance with the notice provisions in Chapter 101, beginning with the start of the 2003-04 school year. 

 

The Maine Department of Education has incorporated the required additional language into the Procedural Safeguards Notice. The attached files contain (A) a printable version of the Notice, which should be used for dissemination to parents and guardians, and (B) a copy of the Notice which has highlights to identify where changes were made.
