RE:                   Chapters 127 and 125

Please share this information with school board members, educators, and other interested parties.

At the conclusion of the second comment period on Chapter 127 "Instructional Program, Assessment, and Diploma Requirements," minor revisions were made and the rule has now been provisionally adopted by the Department and approved by the Attorney General.  On Thursday, February 14, the provisionally adopted rule was submitted to the Legislative Council to be referred to the Education Committee.  A public hearing will be scheduled by the Education Committee on the proposed rule.

A copy of the proposed and provisionally adopted rule is available through the Department of Education website directly at  Also at this site are summaries of the comments received by December 20, 2001 for the first comment period and by February 4, 2002 for the second comment period.  The number of individuals making the same comment is indicated, and responses to comments are also given there.

We appreciate all of the comments received.  The rule we submitted to the Legislative Council is greatly improved as a result of all of this feedback.

Chapter 125 "Basic Approval Standards: Public Schools and School Units", is a joint rule between the Department and the State Board of Education.  This rule is being revised based on comments received and is on the agenda for the next State Board of Education meeting on March 13, 2002.
