The Maine Department of Environmental Protection (Department) hereby gives notice that it will hold a public hearing on the application submitted by the Maine Turnpike Authority for a Natural Resources Protection Act permit. The permit application (Department Project #L-27241-TG-A-N) is part of the Maine Turnpike Authority?s request for approvals to construct a new toll plaza located in York, Maine.

The Department will conduct the hearing in accordance with the provisions of the Maine Administrative Procedure Act (5 M.R.S. §§ 9051-9064) and the Department?s rules governing licensing and hearings (Chapters 2 and 3).

The purpose of the hearing is to receive testimony from interested parties and the general public on whether the proposed project meets the relevant statutory and regulatory licensing requirements. The statutory and regulatory criteria associated with the Department?s review of this license application are: Natural Resources Protection Act (38 M.R.S. §§ 480-A ? 480-JJ), the Department?s Wetlands and Waterbodies Protection Rules (Chapter 310), and the Rules concerning Significant Wildlife Habitat (Chapter 335). Testimony at the hearing will be limited to the criteria described in this notice. The hearing will be held on Monday, May 22, 2017 at 9:00 A.M. at the Kittery Community Center?s Star Theater at 120 Rogers Road, Kittery, Maine. The hearing is open to the public. The daytime portion of the hearing will be devoted to receiving testimony only from the parties (applicant and intervenors) in accordance with procedural orders issued by the Department.

The evening portion of the hearing, beginning at 6:00 P.M., will be devoted to receiving testimony from members of the general public. All testimony will be given under oath and will be subject to cross-examination by the parties and questions from the presiding officer, Department staff, and counsel for the Department. Individuals who are affiliated with, but not an officer of, a party in this matter may testify at the evening session of the hearing in their personal capacity but not as part of the presentation of a party.

The Department will accept written comments from the public during the application review period from now through the close of the hearing on May 22, 2017.

The licensing file associated with the proposed project is available for public review by arrangement during normal business hours (8:00 a.m. to 5:00 p.m.) at the Department?s Southern Maine Regional Office located at 312 Canco Road in Portland, Maine.
