Homeless Students:

Title 20-A: EDUCATION

§1. Definitions

13-A. Homeless student. "Homeless student" means a person eligible to attend elementary or secondary school persuant to section 5201 who:

A. Lacks a fixed, regular and adequate nighttime residence; [1991, c. 608, §1 (New).]

B-1. Is a child or a youth:

(1) Who is sharing a housing of other persons due to loss of housing or economic hardship or a similiar reason; is living in a motel,hotel, trailer park or camping ground due to lack of alternative adequate accomodation; is living in an emergency or transitional shelter; is abandoned in a hospital; or is awaiting foster care placement;

(2) Who is living in a car, park or public space or in an abandoned building, substandard housing, bus or train station or similiar setting;

(3) Who has a primary nighttime residence that is a public or private place not designed for or ordinarily used as a regular sleeping accommodation for human beings; and

(4) Who is a migratory child, as defined in Section 1309 of the federal Elementary and Secondary Education Act of 1965, who qualifies as homless for the purpose oif this chapter because the child is living in circumstances described in this section. [2003, c. 477, §2 (NEW).]

Actually enrolling the student depends on who is actually paying for the student.

Example: Student meets the definition of homeless above, lives in District A but attends school in District B

If District B is paying for the student then either Option 1 or Option 2 may be used. If District A is paying then use Option 3

Option 1:
District B enrolls Primary
Resident Town = town within District B
Fiscal Responsibility = Resident of School Unit

Option 2:
District B enrolls Primary
Resident Town = town within District A
Fiscal Responsibility = Superintendent Agreement

Option 3:
District B enrolls Primary
Resident Town = town within District A
Fiscal Responsibility = Paid by Resident SAU
