WEEKLY NOTICES OF STATE RULE-MAKING
Public Input for Proposed and Adopted Rules

Notices are published each Wednesday to alert the public regarding state agency rule-making. You may obtain a copy of any rule by notifying the agency contact person. You may also comment on the rule, and/or attend the public hearing. If no hearing is scheduled, you may request one -- the agency may then schedule a hearing, and must do so if 5 or more persons request it. If you are disabled or need special services to attend a hearing, please notify the agency contact person at least 7 days prior to it. Petitions: you can petition an agency to adopt, amend, or repeal any rule; the agency must provide you with petition forms, and must respond to your petition within 60 days. The agency must enter rule-making if the petition is signed by 150 or more registered voters, and may begin rule-making if there are fewer. You can also petition the Legislature to review a rule; the Executive Director of the Legislative Council (115 State House Station, Augusta, ME 04333, phone 207/287-1615) will provide you with the necessary petition forms. The appropriate legislative committee will review a rule upon receipt of a petition from 100 or more registered voters, or from "...any person who may be directly, substantially and adversely affected by the application of a rule..." BRIEF SUMMARY: The Board of Licensure in Medicine and the Board of Pharmacy propose a new joint rule relating to collaborative drug therapy management, as established by collaborative practice agreements between practitioners and pharmacists. CHAPTER NUMBER AND TITLE: Ch. 612, Maine Dental Education Loan and Loan Repayment Programs (Amendment 3)
BRIEF SUMMARY: The rule amendment makes changes to the loan repayment program by requiring that payments be made directly to the holders of the loans and clarifying the timing of such payments. The rule amendment also makes changes to the dental education loan program primarily by (a) modifying the application requirements; (b) providing for partial loan forgiveness in the event of eligible but part-time employment; and (c) changing the interest rates for first loans made after January 1, 2016, and renewals of those loans.

RULE TITLE OR SUBJECT: Ch. 25, Lobster and Crab: 25.04, Lobster Trawl Limits; 25.97, Management Framework for Island Limited Entry Program
PROPOSED RULE NUMBER: 2015-P224
CONCISE SUMMARY: This proposed rule provides a seasonal exemption to the existing 3 trap per trawl limit for a specified area within and around the Piscataqua River, allowing up to 10 traps per trawl from January 1-April 10. This change is requested by Zone G fishermen fishing in this area, to improve gear handling and minimize gear loss during the winter months. The proposed regulation also strikes Chebeague Island from the list of islands participating in the Island Limited Entry Program.

CONCISE SUMMARY: This adopted rule has deleted the Wholesale Acquisition Cost (WAC) from the reimbursement rate options. Furthermore, in order to be consistent with state statute 22 MRS  §3174-WW, the no co-payment requirement for smoking cessation products has been added to the pharmacy benefits retroactive to August 1, 2014, for members eighteen (18) years of age or older or who are pregnant. CMS approved these changes December 9, 2014. In addition, some terms have been replaced with nationally recognized language that is considered more respectful of the individual. The term ICF-MR (Intermediate Care Facility for Persons with Mental Retardation) has been changed to ICF-IID (Intermediate Care Facility for Individuals with Intellectual Disabilities).
