Legislative History of Same Sex Marriage in Maine

Introduction

The Defense of Marriage Act was submitted to the Legislature in 1997 as a citizens’ initiative, LD 1017, IB 1. The Legislature enacted the bill, and Governor Angus King let it become law without his signature.

In 2009, LD 1020 proposed allowing same sex marriage in Maine and repealing the 1997 Defense of Marriage Act. A competing measure, LD 1118, was also submitted, which would have expanded domestic partnerships and provided for civil marriage. The Legislature enacted LD 1020 as PL 2009, c. 82, and opponents of same sex marriage immediately initiated a petition for a people’s veto. Maine citizens voted to repeal the act at the November 3, 2009 referendum.


In November 2012, Maine voters approved at referendum LD 1860, IB 3, An Act To Allow Marriage Licenses for Same-sex Couples and Protect Religious Freedom.
