Tina's Law and Subsequent Changes to Maine's Habitual Offender Laws

Introduction

Maine's original habitual offender statutes were enacted in the early 1970s (for a brief history of how these laws changed between the 1970s through the 1990s, see the 2005 Interim Report on Dangerous Drivers: Addressing the Problem of Perpetual Violators in Maine).

In July 2005, Scarborough resident Tina Turcotte was killed in a motor vehicle accident with driver, Scott Hewitt, whose driver's license had been suspended over 20 times. In April 2006, the Legislature enacted PL 2005, c. 606, An Act To Safeguard Maine's Highways, nicknamed "Tina's Law," which made numerous changes to Maine's criminal OUI and habitual offender statutes and created two new motor vehicle crimes: causing serious bodily injury or death while driving with a suspended or revoked license and aggravated operating after habitual offender revocation.
