Does Maine have to be compliant with the HCBS Settings Rule?
Yes. All states must create a plan called a Statewide Transition Plan that outlines the process by which the state will ensure all settings where Medicaid-funded home and community-based services are being delivered fully meet the standards in the HCBS Settings Rule. States are required to submit an "Initial" Statewide Transition Plan to CMS for approval and then submit a "Final" Statewide Transition Plan to CMS for approval. States are further required to fully implement the plan and bring all settings into compliance by March 17, 2022.
There is no opportunity for an extension to the March 17, 2022 deadline. Any setting that is not in full compliance by March 17, 2022 can no longer provider Medicaid-funded home and community-based services.
