Advisory Committee on Fair Competition with Private Enterprise
Deputy Commissioner David Whitt, Chairman
Government entities provide a wide variety of services to its constituency. From time to time, some of those functions may adversely affect private enterprise. The 119th Legislature created the Advisory Committee on Fair Competition with Private Enterprise to review complaints where competition with private enterprise is potentially unfair.
The 121st Maine Legislature expanded the committee's duties in Title 5, section 55-A. These responsibilities are to approve services and goods provided by State agencies that are not otherwise allowed by law, and may compete with private enterprise.
The Advisory Committee consists of members appointed from government agencies, private sector representatives and members of the public who meet to review complaints on government competition with private enterprise. The Commissioner of the Department of Administrative and Financial Services, or their designee, serves as the committee chair.
