Frequently Asked Questions about Independent Contractor Status

As of October 25, 2023, an individual who wants to create a rebuttable presumption of independent contractor status may file a statement - Independent Contractor Statement (Form WCB-267) – with the Board.  The Board will no longer review or approve Predetermination Applications (WCB-266).  This means there are no decisions or paperwork sent from the Board.

The Independent Contractor Statement is effective when it is received by the Board and is valid for one year. 

Information regarding who has filed a statement will be available on this webpage starting November 3, 2023 and updated weekly thereafter. You do not need to file an Independent Contractor Statement until your current predtermination is due to expire (which is one year from the date it is received by the Board).
