Maine law regarding landlord/tenant requirements
Property value less than $750
Property value greater than $750
- If the Unclaimed Property is worth $750 or more, send a letter to the tenant (RTF, 7kb). The letter must be sent by first class mail with proof of mailing (NOT certified mail). You cannot put conditions on the removal of the property, such as demanding outstanding payments.
- If the tenant fails to respond within 14 days or fails to remove his or her property within the allotted time, send a letter to the State Treasurer asking if the Treasurer wants to receive delivery of the property or authorize its sale under Maine's Unclaimed Property Act, Title 33 MRSA Chapter 41 §1954. Mail the letter to: Maine State Treasurer's Office, Attn: Unclaimed Property, 39 State House Station, Augusta ME 04333
- Attach the following documentation with your letter to the State Treasurer:
- Copy of your letter to the tenant
- Proof of mailing to the tenant
- List of the unclaimed items
- If the Treasurer authorizes a sale, you will be notified to sell the property in a commercially reasonable manner. You may deduct any outstanding rent or arrearages and any costs associated with notice, storage and sale.
- If the Treasurer elects to take delivery of the property, you will be notified with delivery instructions.
- The records of the sale and any balance due the owner should be reported and delivered to the Office of the Maine State Treasurer within thirty days from the date of such sale and disposition. The record of the sale must include at a minimum the name of the owner prior to the sale, a description of the property, the amount of the sale, the authorized itemized deductions, and the balance, if any, being remitted.
