Clarifying the Rezoning Criterion of 'Demonstrated Need'

The Commission's zoning system places land into various land use subdistricts. The uses permitted in each subdistrict are intended to protect existing resources and promote compatible uses. Land owners may petition the Commission for a change in subdistrict boundaries to allow new uses to be permitted on their property. Certain rezoning petitions can only be authorized if LURC determines that the petition satisfies a "demonstrated need in the community or area". This document provides guidance to LURC staff as it applies this criterion in evaluating petitions to rezone land. It also provides applicants with guidance on some of the factors the Commission may consider in evaluating need.
