TO: Superintendents of Schools
FROM: Angela Faherty, Ph.D., Commissioner of Education

SUBJECT: Clarification of Medical Use of Marijuana Act

The question of medical marijuana use in schools has arisen. The Maine Medical Use of Marijuana Act (Title 22, Subtitle 2, Chapter 558-A) states that use of marijuana is limited to patients under the care of registered primary caregivers.  It also states in the limitations section of Title 22 M.R.S. §2426 (2009) that possession or use is prohibited on school buses or on school grounds.

The limitations section of Title 22 M.R.S.A. 2426 is available at http://www.mainelegislature.org/legis/statutes/22/title22sec2426.html
