B.Approval of Decision and Order (s)

2009-MFG-5379 (The Oasis)
Carol Roberts motioned to approve the Decision and Order as written. As stated in the Decision and Order the fine will be assessed at $750.00 and the costs in the amount of $305.75 because the licensee did not certify that the violations had been corrected by July 3, 2009. Seconded by Harvey Wallingford. Vote: 5-0-0.
C.Discussion of Small Communities
The Board discussed the problem of collecting fines and costs from communities that have been issued a Decision and Order or Consent Agreement. They discussed the possibility of discounting fines by 20 to 30 percent if the licensees pay by a specific date which would be assessed on a case by case basis. They also discussed the possibility of requiring a responsible community operator. Discussion will be continued at the next Board meeting.
D.Discussion of Floor Joist Repairs
The Board discussed how third-party approved repairs of floor joist or truss damage can affect the resale of a manufactured home.
E.Discussion of Chapter 10, Establishment of License Fee Increase
Bob explained why the Board is currently in a substantial financial deficit and that the current fees are not sufficient to administer the program. Without these fee increases this program cannot continue to operate.
F.ADMINISTRATION
Report from Christopher Mann, Assistant Attorney General
•Christopher Mann, Assistant Attorney General is preparing to submit a motion to Superior Court for preliminary injunction on unlicensed communities. This would ultimately cease the operation of such communities and the owner would have to remove the homes.
Report from Robert LeClair, Executive Director
•Bob Neff, Senior Manufactured Housing Board is retiring after 19 plus years of service with the Manufactured Housing Board; the Board thanked Bob for his dedication and hard work wishing Bob a happy and healthy retirement. Bob offered his inspection priorities to the Board based on health and safety needs:
Protecting the public within communities
Code violations on Modular and Hud homes
Warranty issues on Hud homes
Warranty issues on Modular homes
