Yes. Any gain from the sale that is federally taxable is also taxable by Maine. As such, the consideration, to the extent the gain is taxable, is subject to the Maine Real Estate Withholding requirement. If you believe that any portion of the gain is exempt from Maine taxation, see questions 3 and 4.
