An Order Amending the Order to Improve Review of the Rulemaking Process

AN ORDER AMDENDING THE ORDER TO IMPROVE REVIEW OF THE RULEMAKING PROCESS
WHEREAS, Executive Order 09 FY 11/12 was issued January 10, 2011; WHEREAS, that Order exempted emergency rules from application of its requirements; and
WHEREAS, emergency rulemaking has the potential to negatively impact Maine citizens and businesses;
NOW, THEREFORE, I, Paul R. LePage, Governor of the State of Maine, hereby order as follows:
- Executive Order 09 FY 11/12 is hereby amended by inserting the following Section 4:
“4. No emergency rule may be adopted under 5 M.R.S.A. § 8054 unless the Commissioner or equivalent appointed authority approves adoption of the rule in writing.”
The effective date of this Executive Order is March 11, 2011.
