STATUTORY OR OTHER BASIS: 23 MRSA §4120-A, as enacted by PL 2005, c.282 and amended effective June 18, 2007 by PL 2007 c.306.
PURPOSE OF THE RULE: Pursuant to Ch. 23§ 4120, the Maine Department of Transportation will develop rules to allow for application for reimbursement for relocation of overhead utilities underground in federally designated historic districts to the extent that such payments by the department are eligible for reimbursement under the federal surface transportation program pursuant to 23 United States Code, Section 133(b)(8) (2005).

EXPECTED 2008-2009 RULE-MAKING ACTIVITY: New rule - Transportation Planning Incentive Funding Program

STATUTORY OR OTHER BASIS: 23 MRSA §73-A, as enacted effective September 20, 2007
PURPOSE OF THE RULE: It is the purpose of this rule is to facilitate the establishment and administration of a program of transportation planning incentive funding designed to further the purposes and policies of Title 23 MRSA section 73 and Title 30-A, chapter 187, subchapter 2, to encourage sound transportation planning and protect the integrity of regional transportation systems and thereby prevent or reduce the need for costly future capacity or retrofitting expenditures associated with unmanaged development along state transportation corridors. This rule is adopted pursuant to P.L. 2007, chapter 208, “An Act to Promote Transportation Planning, Increase Efficiency and Reduce Sprawl”, codified at 23 MRSA §73-A.
