EXPECTED 2007-2008 RULE-MAKING ACTIVITY:
CHAPTER 103: Rules for the Sensible Transportation Policy Act
STATUTORY OR OTHER BASIS: 23 MRSA §73, as amended by PL 2003, c.22, and 23 MRSA§ 73-A, as enacted by PL 2007, c. 208 (effective September 20, 2007).
PURPOSE OF THE RULE: The purpose of this rulemaking initiative is to comply with the Legislative mandates contained in PL 2003, c.22 and PL 2007, c. 208. Those laws directed MaineDOT to adopt a rule, in coordination with the State Planning Office, that establishes linkage between the planning processes outlined in the Sensible Transportation Policy Act and those promoted by the Comprehensive Planning and Land Use Regulation Act and that promotes investment incentives for communities that adopt and implement land use plans that minimize over-reliance on the state highway network; and to administer a program of transportation planning incentive funding.

INFORMATION ON ANY PLANNED USE OF CONSENSUS-BASED RULE DEVELOPMENT: The proposed changes are being developed in cooperation with the State Planning Office and the Maine Turnpike Authority, with input from the Maine Municipal Association, Regional Planning Agencies, municipalities and other interested persons and groups; however, the Department is not utilizing the specific consensus-based rule development process set forth in 5 MRSA §§ 8002 (3-C) and 8051-B.
