PURPOSE: This rule is being amended to clarify that the Department may initiate air emissions licensing of CO2budget units and participate in auctions prior to the commencement date of its program; to revise the definition of "fossil fuel-fired unit" that limits the amount of fossil fuel a new source can use without being subject to the program to no more than 5%; to revise the definition of "owner" to clarify the different uses of the term owner within the rule; and add voluntary renewable energy market set-aside provisions.

CHAPTERS 850-857: Hazardous Waste Management Rules
STATUTORY BASIS: 38 MRSA §1319-O(1)
PURPOSE: These rule chapters will be amended to, among other things, incorporate changes in corresponding federal requirements, add requirements for handling waste gas, and update the abbreviated license provisions. Under the latter provisions, license review is streamlined for hazardous waste generators who agree to abide by specified operating standards. The standards vary by facility type.

CHAPTER 3: Certification of Underground Oil Tank Installers (Amendments)
CHAPTER 5: Certification of Underground Gasoline Tank Removers (Repeal)
STATUTORY BASIS: 32 MRSA §§ 10004 et seq. as amended by P.L. 123-292
PURPOSES OF THESE RULES: Establish consistency with recent legislation (P.L. 123-292), eliminate classes of certificates that are not used, and modify the apprenticeship program for applicants in order to better reflect the range of work they would expect and the expected availability of relevant work.
SCHEDULE FOR ADOPTION: November/December 2007.
