CHAPTER 310: Authority

PURPOSE: To repeal the provisions of this chapter as they are not needed.

CONSENSUS-BASED RULE DEVELOPMENT: Not contemplated.

CHAPTER 320: Definitions
STATUTORY AUTHORITY: 10 M.R.S.A. §§ 9005 and 9021
PURPOSE: To change definitions as authorized by Public Law, Chapter 2005,344, also this chapter inserts a table to define “A” work and “B” work.
SCHEDULE FOR ADOPTION: Within one year.

CONSENSUS-BASED RULE DEVELOPMENT: Not contemplated.

CHAPTER 330: Administration
STATUTORY AUTHORITY: 10 M.R.S.A. §§ 9005 and 9021
PURPOSE: To repeal the provisions of this chapter as they are not needed.

CONSENSUS-BASED RULE DEVELOPMENT: Not contemplated.

CHAPTER 340: Licenses
STATUTORY AUTHORITY: 10 M.R.S.A. §§ 9005 and 9021
PURPOSE: To add additional license category as authorized by Public Law, Chapter 2005,344. It also adds standards for the licensure of dealer developers. It imposes a standard for journeyman quality workmanship for all categories of licensees.
SCHEDULE FOR ADOPTION: Within one year.

CONSENSUS-BASED RULE DEVELOPMENT: Not contemplated.

CHAPTER 350: Prohibited practices
STATUTORY AUTHORITY: 10 M.R.S.A. §§ 9005 and 9021
PURPOSE: To reformulate the permissible scope of practice for the different license categories. It also requires the obligation to provide service records. It also includes violation provisions relocated from Chapter 340.
SCHEDULE FOR ADOPTION: Within one year.

CHAPTER 360: Inspections
STATUTORY AUTHORITY: 10 M.R.S.A. §§ 9005 and 9021
PURPOSE: To repeal the provisions of this chapter as they are not needed.

CHAPTER 370: Complaints and investigations
STATUTORY AUTHORITY: 10 M.R.S.A. §§ 9005 and 9021
PURPOSE: The Executive Director may dismiss complaints on behalf of the board when no violation is found on inspection, or when the licensee has corrected the conditions that led to filing of a complaint.
SCHEDULE FOR ADOPTION: Within one year.

CHAPTER 380: Adoption of codes and standards
STATUTORY AUTHORITY: 10 M.R.S.A. §§ 9005 and 9021
PURPOSE: To remove a duplicate recitation of standards for state certified manufactured housing that is also found in Chapter 110 of the board’s rules. To update a reference to HUD safety standards applicable to HUD homes.
SCHEDULE FOR ADOPTION: Within one year.

CONSENSUS-BASED RULE DEVELOPMENT: Not contemplated.

CHAPTER 381: Home installation warranty seal
STATUTORY AUTHORITY: 10 M.R.S.A. §§ 9005 and 9021
PURPOSE: To give the manufacturers slightly more latitude in the placement of the State of Maine Installation Warranty Seal.
SCHEDULE FOR ADOPTION: Within one year.
AFFECTED PARTIES: Licensees and general public.
CONSENSUS-BASED RULE DEVELOPMENT: Not contemplated.

CHAPTER 900: Manufactured housing installation standard
STATUTORY AUTHORITY: 10 M.R.S.A. §§ 9005 and 9021
PURPOSE: To reflect changes mandated by federal regulation. Changes include but are not limited to the requirement of frost protection for foundation systems as well as anchors for all homes in all locations.
SCHEDULE FOR ADOPTION: Within one year if necessary.
AFFECTED PARTIES: Licensees and general public.
CONSENSUS-BASED RULE DEVELOPMENT: Not contemplated.
