EXPECTED 2006-2007 RULE-MAKING ACTIVITY:

CHAPTER 1: Rules Relating to Dental Hygienists
STATUTORY AUTHORITY: 32 M.R.S.A. §1073
PURPOSE: Repeal and replace with “Definitions”. This chapter will be used to give definitions of terminology used within the Board Rules.
ANTICIPATED SCHEDULE: December 2006
AFFECTED PARTIES: All licensees’ of the Maine Dental Board and the citizens of the State of Maine.

CHAPTER 2: Rules Relating to Dental Assistants
STATUTORY AUTHORITY: 32 M.R.S.A. §1073
PURPOSE: Repeal and replace with “Rules Relating to Dental Hygienists”. Also to amend the rule to: (1) Clarify the rules relating to nitrous oxide administration; (2) Include acceptance of a successfully completed Board-administered, national, regional or state examination in the administration of local anesthesia; and (3) To further clarify the rules for PHS hygienists in which they can apply topical antimicrobials.

CHAPTER 3: Rules Relating to the Practice of Denturism
STATUTORY AUTHORITY: 32 M.R.S.A. §1073
PURPOSE: Repeal and replace with “Rules Relating to Dental Assistants”. Also to amend the rule to: (1) Include under general supervision, removal of sutures with a follow-up appointment with the dentist within 7-10 days of suture removal and the pouring and trimming of dental models; (2) Include under direct supervision, the fabrication of temporary crowns and bridges, limiting handpiece rotary instrumentation used in the fabrication only to extraoral use, so long as the dentist checks the occlusion and fit prior to releasing the patient, and remove composite material using slow speed instrumentation for de-bonding brackets, as long as the dentist conducts a final check prior to release of the patient; (3) List the allowable procedures that a permitted EFDA and perform under direct supervision; (4) List the certification requirements by examination and endorsement for an EFDA permit; and to (5) List the continuing education requirements for an EFDA permit.

CHAPTER 9: Licensure Requirements for Dental Radiographers

PURPOSE: Repeal and replace with “Complaints/Investigations/Unprofessional Conduct”.

CHAPTER 10: Requirements for Licensure for Dental Hygienists
STATUTORY AUTHORITY: 32 M.R.S.A. §1073
PURPOSE: Repeal and replace with “Licensure Requirements for Dental Radiographers”.
ANTICIPATED SCHEDULE: December 2006

CHAPTER 11: Educational Requirements for Licensure
STATUTORY AUTHORITY: 32 M.R.S.A. §1073
PURPOSE: Repeal and replace with “Requirements for Licensure as Dental Hygienists”. Also to amend the rule to: (1) add acceptance of any other U.S. state or regional dental hygiene examination, so long as all modules are passed, and the applicant successfully passes the NERB DSCE; or (iii) a national dental hygiene examination approved by the Board; and (2) for purposes of licensure by endorsement, accept a minimum of three years of active clinical practice prior to application.
