EXPECTED 2005-2006 RULE-MAKING ACTIVITY:

At present, it does not appear that MITSC will need to propose rules between now and October 2006. However, this could change if the State, the Penobscot Nation, or the Passamaquoddy Tribe identifies a problem that requires a regulatory solution. If MITSC does decide to propose any rules, the following information would be applicable:

CHAPTER 201: Title Fishing on Waters under Jurisdiction of Maine Indian Tribal-State Commission
STATUTORY OR OTHER BASIS: 30 MRSA §6207(3)
PURPOSE OF THE RULE: To address issues that the State and the Tribes agree require regulatory solution.
SCHEDULE FOR ADOPTION: 2006 (if at all)
LISTING OF AFFECTED PARTIES: Potentially benefited and regulated parties include Passamaquoddy and Penobscot Tribal Members and non-Tribal Members who fish on MITSC waters.
INFORMATION ON ANY PLANNED USE OF CONSENSUS-BASED RULE DEVELOPMENT: MITSC is premised on the concept of consensus. Adoption of MITSC’s rules cannot occur unless there is agreement by the State of Maine, the Passamaquoddy Tribe, and the Penobscot Nation.
