EMERGENCY RULES ADOPTED SINCE THE LAST REGULATORY AGENDA: None

EXPECTED 2005-2006 RULE-MAKING ACTIVITY:

CHAPTER 107: Unfair Trade Practice Rules
STATUTORY AUTHORITY: 5 M.R.S.A. §207(2) (The Maine Unfair Trade Practices Act)
PURPOSE: The Office of the Attorney General expects that these Rules will deal with the following areas:
1. Amend 26-239 Rule 105 Trade Practices in the Sales of New Motor Vehicles to make it consistent with new Rule 104.
ANTICIPATED SCHEDULE: Promulgation of Amendments to Ch. 105 anticipated by June, 2006.
AFFECTED PARTIES: Maine consumers and automobile dealers.
CONSENSUS-BASED RULE DEVELOPMENT: While we will certainly consult with interested parties, the Maine Unfair Trade Practices Act is a law enforcement statute and Consensus-Based Rule Development will not always be appropriate.

CHAPTER 200: Rules for Tobacco Sales
STATUTORY AUTHORITY: 22 M.R.S.A. § 1580-G, et seq. (Tobacco Manufacturers Act) and 22 M.R.S.A. §1580-L (Tobacco Product Manufacturers).
PURPOSE: The Office of the Attorney General expects to promulgate additional Rules pursuant to 22 M.R.S.A. § 1580-G, et seq. and §1580-L to provide tobacco product manufacturers, distributors and retailers with further definitions and instructions for compliance with these laws.
ANTICIPATED SCHEDULE: Promulgation on a priority basis over the course of the next year.
AFFECTED PARTIES: Tobacco manufacturers, importers, distributors, retailers and Maine consumers.
CONSENSUS-BASED RULE DEVELOPMENT: While we will certainly consult with interested parties, the Tobacco Manufacturers Act and the Tobacco Product Manufacturers statute are law enforcement statutes, and Consensus-Based Rule Development will not always be appropriate.

CHAPTER 107: Unfair Trade Practice Rules
STATUTORY AUTHORITY: 5 M.R.S.A. §207(2) (The Maine Unfair Trade Practices Act)
PURPOSE: The Office of the Attorney General expects that these Rules will deal with the following areas:
1. Enact a new rule governing the registration of clinical trials and the reporting of results of clinical trials jointly with DHHS.
ANTICIPATED SCHEDULE: Promulgation of new rule regarding clinical trials registry is anticipated by July 2006.
AFFECTED PARTIES: Maine consumers, health professionals, pharmaceutical companies and bio research companies.
CONSENSUS-BASED RULE DEVELOPMENT: While we will certainly consult with interested parties, the Maine Unfair Trade Practices Act is a law enforcement statute and Consensus-Based Rule Development will not always be appropriate.

CHAPTER 1: Rules for Strip Searches, Manual Mouth Searches, and Body Cavity Searches of Arrestees
STATUTORY AUTHORITY: 5 M.R.S.A. §200-G(1)
PURPOSE: The Office of the Attorney General expects to repeal and replace the present rules to make them consistent with recent changes to the law.
ANTICIPATED SCHEDULE: Promulgation of new rules is anticipated by August 2006.
AFFECTED PARTIES: Arrestees and any state correctional or detention facility, county institution or facility, or local lockup.
CONSENSUS-BASED RULE DEVELOPMENT: While we will certainly consult with interested parties, this matter is one of law enforcement and Consensus-Based Rule Development will not always be appropriate.


No other Board, Unit or Division of the Attorney General’s Office, including the Victim's Compensation Board, has any current plan for rulemaking prior to the next regulatory agenda due date.
