EMERGENCY RULES ADOPTED SINCE THE LAST REGULATORY AGENDA: None

EXPECTED 2002-2003 RULE-MAKING ACTIVITY: The Board may consider reviewing and updating the rules which describes the standards by which a naturopathic doctor may prescribe noncontrolled legend drugs, otherwise known as the formulary, and standards for collaborative relationships between the licensed allopathic or osteopathic physician and the naturopathic doctor. The Board may consider amending the requirements for continuing professional education for acupuncturists and naturopathic doctors. The chapters on the formulary and continuing professional education are major substantive rulemaking. Outdated or duplicative rules that may exist in rules established by the Office of Licensing and Registration as authorized by 10 M.R.S.A. §8003 will be repealed.

CHAPTER 5: Standards for Continuing Professional Education for Acupuncture and Naturopathic Doctors
STATUTORY AUTHORITY: 32 M.R.S.A. § 12526
PURPOSE: The chapter states the requirements for continuing education as required for acupuncturists and naturopathic doctors.

CHAPTER 6: Standards Relating to Prescriptive Authorities and Collaborative Relationships
STATUTORY AUTHORITY: 32 M.R.S.A. §§ 12503(1)(A & B), and 12506
PURPOSE: The formulary listing may be subject to updates and/or revisions based on federal or state standards with regards to noncontrolled legend drugs which may be prescribed according to 32 M.R.S.A. § 12522.
ANTICIPATED SCHEDULE: Within 180 days
AFFECTED PARTIES: Licensees
CONSENSUS-BASED RULE DEVELOPMENT: Not Contemplated

CHAPTER 9: Fees
STATUTORY AUTHORITY: 32 M.R.S.A. §§ 12514 AND 12526
PURPOSE: Establish fees at a level that insures the financial integrity of the Board. This chapter will be repealed. Fees have been established directly by the Director of the Office of Licensing and Registration in Chapter 10 of the Rules of the Office of Licensing and Registration pursuant to 10 M.R.S.A. §8003(2-A)(D).
