RULE-MAKING ACTIVITY:
The Board's current
rules (Chapter 1-6 will be repealed and new rules adopted to implement
PL 2001, c. 261. It is anticipated that the new rules will define specialized
terms, provide for the election of Board officers, set procedures for
issuance of advisory rulings, set standards for the approval of qualifying
educational programs, establish a variance from the educational qualifications,
establish the responsibilities of the sponsor and intern, set the licensing
process for foresters, set the continuing education requirements for
license renewal and implement a registration system for unlicensed individuals
to work under the supervision of a forester.
CHAPTER 10:
Definitions
STATUTORY AUTHORITY: 32 MRSA §5506(4)
PURPOSE: Definition of specialized terms used in the board's rules.
ANTICIPATED SCHEDULE: Within 180 days.
AFFECTED PARTIES: Licensees.
CONSENSUS-BASED RULE DEVELOPMENT: Not contemplated.
CHAPTER 20:
General Information
STATUTORY AUTHORITY: 32 MRSA §5506(4)
PURPOSE: Provides for the election of board officers
ANTICIPATED SCHEDULE: Within 180 days.
AFFECTED PARTIES: Licensees and the public.
CONSENSUS-BASED RULE DEVELOPMENT: Not contemplated.
CHAPTER 30:
Advisory Rulings
STATUTORY AUTHORITY: 5 MRSA §§8051, 9001(4)
PURPOSE: Provides for the discretionary issuance of advisory rulings
by the board.. ANTICIPATED SCHEDULE: Within 180 days.
AFFECTED PARTIES: Licensees and the public.
CONSENSUS-BASED RULE DEVELOPMENT: Not contemplated.
CHAPTER 40:
Educational Qualifications for Issuance of an Intern Forester License
STATUTORY AUTHORITY: 32 MRSA §§5506(1)
PURPOSE: Establishes standards for approval of educational programs
that qualify graduates to apply for the intern forester license.
ANTICIPATED SCHEDULE: Within 180 days.
AFFECTED PARTIES: Licensees and the public.
CONSENSUS-BASED RULE DEVELOPMENT: Not contemplated.
CHAPTER 50:
Variance From Educational Qualifications for issuance of an Intern Forester
License
STATUTORY AUTHORITY: 32 MRSA §5514(2)
PURPOSE: Provides a pathway to licensure for applicants who do not meet
the educational qualifications contained in Chapter 40.
ANTICIPATED SCHEDULE: Within 180 days.
AFFECTED PARTIES: License applicants.

CHAPTER 60:
Sponsorship of Intern Foresters
STATUTORY AUTHORITY: 32 MRSA §5515(10
PURPOSE: Establishes the responsibilities of intern foresters and their
sponsors.
ANTICIPATED SCHEDULE: Within 180 days.
AFFECTED PARTIES: Licensees and the public.
CONSENSUS-BASED RULE DEVELOPMENT: Not contemplated.
CHAPTER 70:
Licensure as Forester
STATUTORY AUTHORITY: 32 MRSA §5506(2)
PURPOSE: Describes the licensure process following completion of the
internship.

CHAPTER 80:
Continuing Forestry Education
STATUTORY AUTHORITY: 32 MRSA §5517(7); 32 MRSA §59-B, as enacted by
PL 2001 c. 285.
PURPOSE: Establishes the minimum continuing education required for license
renewal.
ANTICIPATED SCHEDULE: Within 180 days.

CHAPTER 90:
Registration and Supervision of Unlicensed Personnel
STATUTORY AUTHORITY: 32 MRSA §5515(10)(B)
PURPOSE: Implements a registration system for unlicensed individuals
working under the supervision of a forester.
ANTICIPATED SCHEDULE: Within 180 days.
AFFECTED PARTIES: Licensees and the public.

CHAPTER 100:
Unprofessional Practice; Code of Ethics
STATUTORY AUTHORITY: 32 MRSA §5506(3)
PURPOSE: Defines unprofessional practice to include, but not be limited
to, the Code of Ethics adopted by the board as this chapter.
ANTICIPATED SCHEDULE: Within 180 days.
AFFECTED PARTIES: Licensees and the public.
CONSENSUS-BASED RULE DEVELOPMENT: Not contemplated.
CHAPTER 110:
Transition Provisions
STATUTORY AUTHORITY: PL 2001, c. 261, §6(3)
PURPOSE: Provides a method for certain applicants to demonstrate that
they have met the education provisions of prior law pursuant to PL 2001,
c. 261, §6.
ANTICIPATED SCHEDULE: Within 180 days.
