Client Drug Testing and Client Disciplinary Procedures

CHAPTER 1: Detention and Correctional Standards for Counties and Municipalities
STATUTORY AUTHORITY: 34-A MRSA, Section 1208
PURPOSE: Revision of existing rule. The purpose of the amendment is to clarify standards regarding juvenile detention and revise adult standards to keep pace with professional practices.
ANTICIPATED SCHEDULE: Summer adoption.
AFFECTED PARTIES: Benefited parties: offenders. Regulated parties: county jails.

CHAPTER 10: Detention and Correctional Standards for State Facilities
STATUTORY AUTHORITY: 34-A MRSA, Section 1402
PURPOSE: Revision. The purpose of the rule is to create uniform standards for state correctional facilities.
ANTICIPATED SCHEDULE: Winter/Spring adoption.
AFFECTED PARTIES: Benefited parties: prisoners. Regulated parties: state facilities

CHAPTER 10, Sec. 15.1: Client Disciplinary Procedures
STATUTORY AUTHORITY: 34-A MRSA, Section 3032
PURPOSE: Revision of existing rule. The purpose of the amendment is to clarify and add new disciplinary offenses for adult and juvenile clients.
ANTICIPATED SCHEDULE: Winter/Spring adoption.
AFFECTED PARTIES: Regulated parties: Adult and juvenile offenders sentenced to the Department

CHAPTER 10, Sec. 18.8: Work Release
STATUTORY AUTHORITY: 34-A MRSA, Section 3035
PURPOSE: Revision of existing rule. The purpose of the amendment is to clarify when a prisoner may be eligible for or removed from work release.
ANTICIPATED SCHEDULE: Winter/Spring adoption.
AFFECTED PARTIES: Regulated parties: prisoners

CHAPTER 10, Sec. 6.6: Restitution
STATUTORY AUTHORITY: 34-A MRSA, Section 1402
PURPOSE: Revision of existing rule. The purpose of the amendment is to make the existing rule consistent with recent statutory changes.
ANTICIPATED SCHEDULE: Spring adoption.
AFFECTED PARTIES: Benefited parties: victims. Regulated parties: prisoner

CHAPTER 10, Sec. 9.15 & 9.15J: Client Drug Testing
STATUTORY AUTHORITY: 34-A MRSA, Section 1402
PURPOSE: Revision of existing rule. The purpose of the amendment is to simplify the procedure for adult and juvenile client drug testing.
ANTICIPATED SCHEDULE: Winter/Spring adoption.
AFFECTED PARTIES: Regulated parties: Adult and juvenile offenders sentenced to the Department

CHAPTER 10, Sec. 18.6: Furlough
STATUTORY AUTHORITY: 34-A MRSA, Section 3033
PURPOSE: Revision of existing rule. The purpose of the amendment is to clarify when a prisoner may be removed from furlough.
ANTICIPATED SCHEDULE: Winter/Spring adoption.
AFFECTED PARTIES: Regulated parties: prisoners

CHAPTER 10, Sec. 25.3.4: Supervised Community Confinement
STATUTORY AUTHORITY: 34-A MRSA, Section 3036-A
PURPOSE: Revision of existing rule. To address changes in eligibility standards for prisoner participation.
ANTICIPATED SCHEDULE: Fall adoption.
AFFECTED PARTIES: Regulated parties: State adult facilities and community corrections prisoners sentenced to the Department

CHAPTER 11: Contingency Plan for Testing and Release of HIV Information
STATUTORY AUTHORITY: 5-A MRSA, Section 19023
PURPOSE: Revision of existing rule. The purpose of the amendment is to clarify to whom the department may release the results of HIV testing. Also to designate who may receive test results from county jails, as required by a recent statute.
ANTICIPATED SCHEDULE: Fall adoption.
AFFECTED PARTIES: Regulated parties: prisoners and county facilities

CHAPTER 15: Batterers' Intervention Certification
STATUTORY AUTHORITY: 34-A MRSA
PURPOSE: Revision. The purpose of the amendment is to revise standards for the certification of batterersū intervention programs
ANTICIPATED SCHEDULE: Spring/Summer adoption.
AFFECTED PARTIES: Regulated parties: batterersū intervention programs.
