The Motor Carrier Review Board met on September 21, 2012.  The meeting was called to order at 8:13 AM.

Minutes of the June 19, 2012 Board meeting were approved. David/Bruce – Unanimous

Announcements:

  • Francis announced that Angela had transferred to another position and this would be her last meeting.  He thanked her for her work to date on behalf of the Board.  Brian Parke also thanked her on behalf of the Board.
  • Francis announced that UCR registration for 2013 begins October 1, 2012 and the enforcement date for 2013 will be January 1, 2013.
  • Garry let the Board know that the bid process for the IFTA processing system closed on September 20th and the State had received two bids which would be evaluated shortly.
  • Garry announced that the IFTA/IRP auditors moved from Maine Revenue Services to the Bureau of Motor Vehicles as a result of a legislative change and will report directly to him.
  • Garry updated the Board on the progress of the transponder installation at the Kittery weigh station.

Other than the supplemental questionnaires received there were three pieces of correspondence for the Board to review:

  • A letter dated September 14, 2012 from Sharon Spaulding on behalf of D L Spaulding Trucking.
  • A copy of a July 30, 2012 FMCSA compliance review of Robin A Crawford & Son Woods Company Inc along with copies of several policies instituted since the review.  The information was provided by Tammy MacEachern on behalf of Robin A Crawford & Son Woods Company Inc.
  • A letter dated September 18, 2012 from Michael A. Dibona Jr.

Review of “A” Carriers:

Gateway Inn – USDOT Number 784469
RSR 120.69; Indefinite suspension of Gateway Inn and all related entities with restoration conditional upon the carrier submitting a safety plan and appearing before the Board; David/Russell – 5 to 0 In Favor, 1 Abstention

Gateway Inn, of Medway, Maine is an inactive interstate private property carrier of biomass operating 7 power units and 7 (3 CDL) drivers.

During the review period (April 1, 2010 to March 31, 2011) the carrier had 29 violations (three serious) for a total of 105.00 points, including 1 speeding 15 or more miles per hour over the speed limit, 1 tire-other tread depth less than 2/32 of inch, 1 speeding 11-14 miles per hour over the speed limit, 1 inoperative tail lamp, 1 excess vehicle weight, 1 brake-reserve system pressure loss, 3 insufficient brake linings, 1 brakes (general), 1 inoperative/defective brakes, 3 operating a commercial motor vehicle without periodic inspection, 1 wedge type brake(s) out of adjustment, 1 clamp/roto-chamber type brake(s) out of adjustment, 1 operating over height, 1 fifth wheel, 1 improper battery installation, 1 inoperative required lamps, 1 frame cracked/loose/sagging/broken, 3 inspection/repair and maintenance parts and accessories, 1 failure to provide evidence of insurance, 1 operating beyond over limit permit, 1 operating intrastate commercial without registration, 1 failure to display fuel decal, and 1 windshield wipers inoperative/defective.  The carrier’s reported Maine mileage is 87,341 miles (FUID) resulting in an RSR of 120.69.

The carrier is not rated in the Safety Measurement System due to an inactive USDOT Number.  The carrier has a MCSIP Step of 0 (not targeted) and an ISS inspection selection value of 50 (optional).

This is a continuation of the full hearing held on March 6, 2012 and continued to the June 19, 2012 meeting.  At its June 19, 2012 meeting, the Board voted to continue the hearing with a second request for the carrier to submit a full safety plan for both Gateway Inn and McLaughlin’s Timber Trucking Inc. at least 30 days prior to today’s hearing.  A hearing continuance notice, a safety plan outline, and a supplemental questionnaire were sent to the carrier via FedEx on June 19, 2012.  Receipt was acknowledged on June 21, 2012.  A Board staff member spoke with Ms. McLaughlin on July 9, 2012.  Ms. McLaughlin stated that the carrier is out of business and all commercial plates over 10,000 pounds are expired and/or returned.  To date, neither the supplemental questionnaire nor the safety plan has been submitted for the Board’s review.

McLaughlin’s Timber Trucking Inc (USDOT Number 676054), a related company due to common ownership, had three recent inspections (7/23/2012; 8/14/2012; 8/29/2012) with a total of 14 violations ( two serious) including 1 damaged securement system/tiedowns, 1 axle positioning parts defective/missing, 1 inoperative turn signal, 1 inoperative or defective brakes, 1 no or defective brake warning device, 1 brake hose or tubing chafing and/or kinking, 1 defective/improper fifth wheel assemblies, 1 unsafe operations forbidden, 3 inspection/repair and maintenance parts and accessories, 1 failure to display fuel decal, and 2 failure to display name/USDOT number on truck/tractor.

McLaughlin’s Timber Trucking Inc is not rated in the Safety Measurement System and has a MCSIP Step of 0 (not targeted) and an ISS inspection selection value of 70 (optional).

The Board voted to suspend the carrier and all related entities based on the carrier’s safety record and also the similar pattern of recent safety violations by the related entity, McLaughlin’s Timber Trucking Inc.  The suspension is indefinite until such time as the carrier submits a safety plan to the Board and appears before the Board to answer questions regarding management’s policies and procedures to address the Board’s safety concerns.

 

Ridge Road Express Inc – USDOT Number 1475241
RSR 80.95; Continuance with a request for the carrier to provide a written explanation of the safety plan and the effect it is having on correcting safety, driver, and vehicle issues, with examples, to help the Board understand what the carrier has put in place to address the safety and operating issues before the Board; the Board also strongly requests the presence of a company representative at the next meeting to present testimony about the results of the safety plan submitted to the Board; Russell/Patrick – 5 to 0 In Favor, 1 Abstention

Ridge Road Express Inc, of Houlton, Maine is an interstate for-hire carrier of general freight and fresh produce operating 3 power units and 4 CDL drivers.

This is a continuation of the full hearing held on March 6, 2012 and continued to the June 19, 2012 meeting.  At its June 19, 2012 meeting, the Board voted to issue a request for the carrier to submit a safety plan and updated supplemental questionnaire within 30 days.  If the requested material was received by the Board the hearing was to be continued, otherwise the Board recommended a 30-day suspension to the Secretary of State, with the submission of a safety plan as a condition of restoration.   A hearing notice, safety plan outline, and a supplemental questionnaire were sent to the carrier via FedEx on June 20, 2012.  Receipt was acknowledged on June 25, 2012.  The carrier’s supplemental questionnaire and IFTA tax reports were received on June 25, 2012.  After several follow-up communications with the carrier, the safety plan was received on August 1, 2012.  There are eight additional violations to report (one serious) since the last meeting (see 6/26/2012 violation date on the MCRB Summary).

Follow Up of “B” Carriers (From June 14, 2011 Meeting):

Tremblay & Levesque Inc- USDOT Number 755125
RSR 55.94; No Further Action; Patrick/Alan - Unanimous
This is a continuation of a B review held on June 19, 2012.  At that meeting the Board issued a request for a safety plan that addressed the carrier’s vehicle maintenance procedures.  The continuation letter and request for a safety plan were sent to the carrier by FedEx on June 21, 2012.  Receipt was acknowledged on June 22, 2012.  On July 19, 2012 the carrier submitted an incomplete supplemental questionnaire without a safety plan.  Several additional notices requesting a completed questionnaire and safety plan were sent to the carrier.  On August 29, 2012 the carrier’s questionnaire and safety plan were received.  The questionnaire was still incomplete – no plates were listed for question number 5 and no drivers were listed for question number 8.  The carrier’s MCRB summary was updated using the carrier’s reported mileage and the new MCRB scoring procedures.  The carrier’s updated RSR is 55.94.

There are two new violations to report since the last meeting, both for excess vehicle weight.

The carrier has a current Vehicle Maintenance BASIC of 88.0 (Monitor Status), a Crash Indicator BASIC of 53.0, a MCSIP Step of 0 (not targeted), and an ISS inspection selection value of 72 (optional).

Black Dog Trucking LLC – USDOT Number 1790614
RSR 1914.29; No Further Action; Patrick/Bruce - Unanimous
A warning letter and supplemental request were sent to the carrier via FedEx on June 22, 2012, and delivered to the carrier on June 26, 2012.  The carrier’s USDOT census status was made inactive/out-of-business on July 10, 2012.  A second request for supplemental information was sent by first class mail and fax on August 8, 2012.  No information has been received to date.  The carrier’s MCRB summary was updated using the new MCRB scoring procedures.  The carrier’s updated RSR is 1914.29.

There are two new serious violations to report since the last meeting, both for false report of driver’s record of duty status.

The carrier is currently not rated in the Safety Measurement System due to the inactive census status and has a MCSIP Step of 0 (not targeted) and an ISS inspection selection value of 50 (optional).

Basil J Stratton – USDOT Number 1970679

A warning letter and supplemental request were sent to the carrier via FedEx on June 22, 2012, and delivered to the carrier on June 27, 2012.  A second request for the supplemental information was sent by first class mail on August 8, 2012.  The carrier’s supplemental has not been received to date.  The carrier’s MCRB summary was updated using the new MCRB scoring procedures.  The carrier’s updated RSR is 455.56.

Gary J Vaillancourt, dba Vaillancourt Transport, of Van Buren, Maine is an interstate for-hire carrier of general freight, logs, poles, beams, lumber, building materials, fresh produce, meat, dry bulk commodities, refrigerated food, beverages, and paper products operating 17 power units and 29 (28 CDL) drivers.

During the review period the carrier had 25 violations (13 serious) for a total of 138.00 points, including 1 speeding 11-14 miles per hour over the speed limit, 1 failing to use seat belt while operating commercial motor vehicle, 1 false report of driver’s record of duty status, 6 requiring or permitting driver to drive more than 11 hours, 4 requiring or permitting driver to drive after 14 hours on duty, 1 steering system components worn/welded/missing, 1 following too close, 4 driver’s record of duty status not current, 1 improper passing, 1 ABS-malfunctioning circuit/signal, 2 log violation (general/form and manner), 1 inoperative required lamps, and 1 expired medical examiner’s certificate .  The carrier’s reported Maine mileage is 840,708 miles (IFTA CH) resulting in an RSR of 16.41.

The carrier had one tow-away accident during the review period.

After the review period the carrier had 12 violations (six serious), including 4 requiring or permitting driver to drive after 14 hours on duty, 2 driving beyond 11 hour limit in a 14 hour period, 1 steering system components worn/welded/missing, 1 driver’s record of duty status not current, 1 failing to secure brake hose/tubing against mechanical damage, 1 ABS-malfunctioning circuit/signal, 1 no/defective lighting devices/reflective devices/projected, and 1 inoperable plate light on trailer.

The carrier has a current Unsafe Driving BASIC of 73.7 (Monitor Status), a Fatigued Driving BASIC of 95.9 (Monitor Status), a Vehicle Maintenance BASIC of 17.0, and a Crash Indicator BASIC of 76.3 (Monitor Status).  The carrier has a MCSIP Step of 0 (not targeted) and an ISS inspection selection value of 96 (inspect).  This is the carrier’s first preliminary review.

Mr. Vaillancourt appeared before the Board.  He testified that he never required his drivers to exceed the hours-of-service requirements and has put a disciplinary policy in place to correct driver behavior.  Mr. Vaillancourt also invited DOT to his place of business to do a presentation on hour-of-service requirements and has acquired a log-checker program to aid in identifying drivers that are falsifying logs.  He stated that he understands that he is ultimately responsible for his drivers and has met face to face with them and told them they need to obey the laws or move on.

20. Robin A Crawford & Son Woods Company Inc – USDOT Number 434664

Robin A Crawford & Son Woods Company Inc, of Lincoln, Maine is an interstate for-hire carrier of logs, poles, beams, lumber, and wood chips operating 29 power units and 22 CDL drivers.

The carrier has a current Unsafe Driving BASIC of 78.7 (Monitor Status), a Vehicle Maintenance BASIC of 71.9, a Cargo-Related BASIC of 51.6, and a Crash Indicator BASIC of 88.4 (Monitor Status).  The carrier has a MCSIP Step of 22 (targeted) and an ISS inspection selection value of 97 (inspect).  This is the carrier’s first preliminary review.

The Board reviewed a copy of a July 30, 2012 FMCSA compliance review of Robin A Crawford & Son Woods Company Inc along with copies of several policies instituted by the company after the review.  The information was sent to the Board by Tammy MacEachern on behalf of the company.

Brian Parke suggested that the Board needs to examine how it might better use existing resources to target its efforts towards the carriers that most need the Board’s attention.  It was suggested that at the next meeting the Board might have a work session to discuss possible changes in procedures to better accomplish the Board’s mandate.  It was suggested that Maine State Police Lt. Shawn Currie, Deputy Secretary of State, Tom Arnold, and a representative from the local FMCSA office be asked to attend the meeting.  A motion was made to forego the preliminary reviews (Top Twenty) at the next meeting, and only review the Letter A and Letter B carriers from today’s meeting.  Alan/Bruce - Unanimous
