Garry Hinkley spoke briefly about Maine’s efforts to resolve  the remaining issues preventing Maine from reaching CVISN Level 1 compliance and future plans for expanded CVISN initiatives; Maine’s completion of the PRISM pilot with Explore Information Services LLC to update Maine’s IRP system to comply with PRISM requirements to eliminate the ‘Registrant Only’ USDOT Number; and the Bureau of Motor Vehicles plan to submit an ‘Request for Proposal’ for an International Fuel Tax Agreement (IFTA) fuel tax processing and management system.

Gateway Inn, of Medway, Maine is an interstate (changed 12/15/2011 from intrastate) private property carrier of biomass (formerly motor vehicles, logs, poles, beams, lumber, and machinery) operating 7 power units and 7 (3 CDL) drivers.

This is a continuation of the full hearing held on March 6, 2012.  At that meeting, the Board voted to continue the hearing with a request for the carrier to submit a full safety plan for both Gateway Inn and McLaughlin’s Timber Trucking Inc. at least 30 days prior to today’s hearing.  A hearing continuance notice, a safety plan outline, and a supplemental questionnaire were sent to the carrier via FedEx on March 7, 2012.  Receipt was acknowledged on March 9, 2012.  A second request for the supplemental information was sent by first class mail and fax on April 4, 2012. A Board staff member spoke with Ms. McLaughlin on June 4, 2012.  A safety plan outline was faxed to the carrier.  Ms. McLaughlin stated that the carrier had no plans to attend the hearing.  To date, neither the supplemental questionnaire nor the safety plan has been submitted for the Board’s review.

Ridge Road Express Inc – USDOT Number 1475241

A Board staff member spoke with Mr. Shaw on June 4, 2012.  The carrier was unsure whether he would attend the hearing, but stated he would submit the supplemental information prior to the meeting.  To date, the safety plan has not been submitted for the Board’s review.

The carrier reported that he controls commercial motor vehicles registered to M C Disposal Inc., dba Central Maine Disposal and Abbott Trucking & Logging LLC.  Abbott Trucking & Logging LLC is on the current Top Twenty list.

There are three new violations to report since the last meeting (none serious), including 1 unsecured load and 2 operating intrastate commercial without registration.

A warning letter and supplemental request were sent to the carrier via FedEx on March 7, 2012, and delivered to the carrier on March 8, 2012.  A second request for the supplemental was sent by fax and first class mail on April 4, 2012.  On April 13, 2012, a Board staff member spoke with a company representative and emailed the carrier the supplemental form and MCRB Summary.  On June 4, 2012, a Board staff member sent an email to the carrier inquiring about the supplemental.  The carrier’s supplemental questionnaire has not been received to date.

There are no new violations to report since the last meeting.

The carrier currently has a Fatigued Driving BASIC, a Driver Fitness BASIC, and a Controlled Substances and Alcohol BASIC all in Monitor Status.  The carrier has a MCSIP Step of 55 (Federal OOS: Unfit Motor Carrier) and an ISS inspection selection value of 100 (inspect).  The carrier is still suspended under the PRISM program and also for non-compliance with UCR (2012) and IFTA.

A warning letter and supplemental request were sent to the carrier via FedEx on March 7, 2012, and delivered to the carrier on March 8, 2012.  A second request for the supplemental was sent by first class mail on April 4, 2012.  The carrier’s supplemental questionnaire was received on May 7, 2012.  The carrier reported 79,230 Maine miles for the review period.  The carrier’s recalculated RSR is 57.59.
