The Motor Carrier Review Board met on June 3, 2008. The meeting was called to order at 9:02 AM.

The following Board members were present: Mark Hutchins, Chair; Dale Hanington; Steven Izer; George Parke; Alan Quinlan; Ron Hutchins.

BMV Attendees: Garry Hinkley, Francis Fox, Patrick Malloy, and Nicole Ibarguen.

The March 20, 2008 minutes were approved. Steve/George – Unanimous.

Announcements/Presentations:

Secretary of State Matthew Dunlap addressed the Board. The Secretary of State commented that he has always been interested in the concept of the Motor Carrier Review Board. He stated that he was very pleased with the Board's work to date and thought their deliberations, observations, and difficult decisions provided a great service to the driving public. The Secretary said that he was always proud to support the Board, even when doing so was difficult or unpopular, because he always felt like he was saving lives. The Secretary announced that George Parke was leaving the Board after twelve years of service; he thanked George for his time, effort, dedication, and commitment to improving motor carrier safety in Maine. The Secretary presented George with a plaque in recognition of his distinguished service and thanked all Board members for their service to the citizens of Maine.

The Maine Forest Products Council has recommended Patrick Sirois to replace George Parke on the Board. The Secretary of State’s Office is working with Pat to secure his nomination in the very near future.

UCR Update –UCR enforcement for Maine-based carriers began June 1, 2008. Maine carriers have had ample notice and time to comply with UCR requirements for 2008. All Maine UCR data is current in SAFER. The national recommended enforcement date was moved back to July 1, 2008 because some states were late getting their mailings out and the UCR data for some states in not current in SAFER. Maine will begin enforcement for all carriers on July 1, 2008.

Garry Hinkley gave an update on the status of BMV computer systems:

Bull Migration Project:

  • Long Term Trailer is very close to implementation.
  • The Titles application is coming along nicely.
  • Motor Carrier Services is scheduled for kick-off within the week.

IRP Computer Project – contract awarded to Explore Information Services, LLC; Explore has systems in Delaware, Minnesota, and Texas; work is expected to begin July 1, 2008.

CVIEW Computer Project – contract awarded to Iteris; currently in contract negotiations.

Kittery I-95 Automated Commercial Vehicle Screening System – in the RFP evaluation stage.

Review of “A” Carriers:

Carl T. Nankervis, Jr. – USDOT Number 792816

RSR 54.5; Prior to the meeting, at the request of the Chair and in consultation with other Board members, the decision was made not to conduct a full review of the carrier – record did not merit full review.

Carl T. Nankervis, Jr., dba Nankervis Trucking, of Franklin, Maine is an exempt for-hire carrier of construction cargo, operating 4 power units and 1 CDL driver.

During the review period (10/01/2006 to 09/30/2007), the carrier had 5 violations (none serious) for a total of 16.5 points, including 2 excess vehicle weight, 1 inadequate brakes, 1 inadequate tires, and 1 failure to display flags or flares. The carrier’s Maine mileage is 30,257 miles (FUID) resulting in a RSR of 54.5.

This is the carrier’s first full review.

The carrier has a current Vehicle SEA of 91. The carrier is SafeStat Category F, with a MCSIP Step of 0 (not targeted) and an ISS of 82 (inspect). This is the carrier’s first full review. The carrier had two previous warning letters.

The carrier has not provided any supplemental information to date. The carrier supplement and MCRB were faxed to the carrier on 5/15/2008.

Andrew Hodgkins, dba A C E Trucking – USDOT 820463

Dropped from B Carrier List.
The carrier’s supplement was received on 3/20/2008; the carrier had one conviction for inadequate brakes after the review period that was not shown on the MCRB Summary for the December 19, 2007 preliminary review.

Pellscot LLC - USDOT Number 991392

Dropped from B Carrier List.
The carrier has not provided any supplemental information to date. A Bureau Investigator hand delivered a MCRB packet on 04/24/2008. A call was placed on 05/15/2008 – there was no answer.

The carrier has one conviction for excess vehicle weight (02/07/2008) after the review period that was not shown on the MCRB Summary for the December 19, 2007 preliminary review.

The carrier has a current Accident SEA of 55 and a Vehicle SEA of 73 (down from 70 and 83 respectively since Dec. 2007). The carrier is not rated in SafeStat, and has a MCSIP Step of 0 (not targeted) and an ISS of 69 (optional).

Voisine & Sons Logging Inc – USDOT Number 743718

The carrier returned the supplement and reported Maine mileage of 342,740 which lowered the RSR to 11.9. [claims all trucks to the same exact trips and have the same yearly mileage, 68,548]

The carrier has two convictions, 1 speeding in a commercial motor vehicle more than 14 mph over the limit (12/07/2007) and 1 failure to display a valid inspection certificate (03/24/2008), after the review period. The carrier has an OOS inspection as late as 04/11/2008 and was cited (not convicted) for excess vehicle weight and failure to display name on truck.

The carrier had one accident after the review period.

The carrier has a current Vehicle SEA of 89 (up from 78 since March 2008). The carrier is currently in SafeStat category F, and has a MCSIP Step of 0 (not targeted) and an ISS of 81 (inspect).

    Wallboard Supply Co Inc, of Londonderry, New Hampshire is an interstate private property carrier of building materials, operating 29 power units and 34 drivers (24 CDL drivers).

During the review period (Jan. 1, 2007 to Dec. 31, 2007), the carrier had 6 violations (none serious) for a total of 19.8 points, including 1 unsafe commercial motor vehicle, 1 speeding in a commercial motor vehicle more than 14 mph over the limit, 1 excess vehicle weight, 1 inadequate tires, 1 operating over width, and 1 failure to display flags/flares. The carrier’s reported Maine mileage is 130,702 miles (IFTA) resulting in a RSR of 15.1.

The carrier had 1 accident during the review period.

After the review period the carrier had four violations including 1 inadequate tail light (02/08/2008), 1 inoperative lights (02/08/2008), and 2 excess vehicle weight (04/22/2008).

The carrier also has two active FTA's.

The carrier has a current Driver SEA of 51 and a Vehicle SEA of 66. The carrier is not rated in SafeStat and has a MCSIP Step of 0 (not targeted) and an ISS of 64 (optional). This is the carrier’s third preliminary review (No Action – 06/01/2004 & 12/07/2006).

New Business:

A motion was made to elect Dale Hanington Vice Chair. Steve/George – Unanimous.

Mark Hutchins requested that a hard copy of the Motor Carrier Review Board Review Summary Statistics Report only be sent annually to the Board Members. It was decided to send an electronic copy of the document to the Board Members prior to each meeting and that there was no reason to send a hard copy annually.

The Board and support staff discussed whether or not it might be time to examine the criteria for bringing carriers before the Board as the number of carriers selected for preliminary review has declined recently and some carriers with very poor federal safety ratings are not being selected for Board review at all. It was decided that support staff would draft a proposal for Board consideration at the next meeting.
