The Maine Motor Carrier Review Board met on June 14, 2007.


The following Board members were present:

Mark Hutchins, Chair; George Parke; Dale Hanington; Ron Hutchins; and Steve Izer.


BMV attendees:

Garry Hinkley, Francis Fox, Patrick Malloy, Nicole Ibarguen, and Clarissa Hurley.


The March 6, 2007 meeting minutes were approved.


Announcements:
Colleen Weed has returned to Motor Carrier Services. She is the new Senior Section Manager in MCS.

Francis Fox will begin assuming Garry’s MCRB tasks.

Garry talked about the visit we had from Bill Campbell, the Driver Safety Liaison for Western Express. Bill has been charged with improving the safety record for Western Express; he has been traveling throughout the country visiting terminals and weight stations during inspections for Western Express drivers. Bill would like to attend the Board meeting in the fall to learn more about the process and meet the Board members.

Review of “A” Carriers (review period 10/01/2005 to 09/30/2006):

Crystal Rock Leasing Co; RSR 9976.2; 60 Day Suspension, Letter A. Dale/George – Unanimous.

Crystal Rock Leasing Co of Pittsfield, Massachusetts is a private property carrier of carnival and amusement equipment. USDOT Number 684714. The carrier operates with two power units and two drivers. This is the carrier’s first (full) review.

During the review period, the carrier had 17 violations (9 serious) for a total of 84.0 points, including 1 operating commercial motor vehicle out-of-service, 2 falsifying logs, 3 operating without duty status log, 3 operating with an unqualified driver, 3 unsafe commercial motor vehicle, 2 operating without medical certificate, 2 failure to provide proof of commercial motor vehicle inspection, and 1 failure to comply with IRP.     During the review period, the carrier had 5 violations (none serious) for a total of 14.7 points, including 2 excess vehicle weight, 1 operating beyond road restrictions, 1 failure to provide proof of commercial inspection, and 1 operating intrastate commercial without registration. The carrier’s reported Maine mileage is 86,250 miles resulting in a RSR of 17.

    The carrier has a Vehicle SEA of 53, and is Safestat Category H, with a MCSIP Step of 0 (not targeted) and an ISS of 75 (inspect). This is the carrier’s first preliminary review.

    During the review period, the carrier had 6 violations (none serious) for a total of 19.6 points, including 4 excess vehicle weight and 2 failure to provide proof of commercial inspection. The carrier’s reported Maine mileage is 119,486 miles resulting in a RSR of 16.4.

    The carrier has a Driver SEA of 74, and a Vehicle SEA of 94. The carrier is Safestat Category F, with a MCSIP Step of 0 (not targeted) and an ISS of 83 (inspect). This is the carrier’s first preliminary review.
  20. Jonathan B. Canty; RSR 15.3; No Action. George/Dale – Unanimous.
    Jonathan B. Canty, dba Jon Canty Construction, of West Gardiner, Maine. USDOT Number 744640. The carrier is an intrastate private property carrier of machinery, operating 8 power units and 8 drivers.

    During the review period, the carrier had 5 violations (none serious) for a total of 17.4 points, including 2 excess vehicle weight, 2 operating over posted weight, and 1 failure to provide proof of commercial inspection. The carrier’s reported Maine mileage is 114,059 miles resulting in a RSR of 15.3.

    The carrier has a MCSIP Step of 0 (not targeted) and an ISS of 85 (inspect). This is the carrier’s first preliminary review.

    Mr. Canty sent a letter to the board which was part of the packet the Board received this morning.

Old Business:

  1. Board Member reappointments – Mark (expired 12/31/2006), Bruce (expired 12/31/2006), Ronald expired (12/31/2005), Alan (expired 12/31/2005), and George (expired 12/31/2005).

    Dale and Steve have terms expiring 12/31/2007.

    Subsequently, George has made it known that he does not want to be reappointed, but he will continue until a successor is appointed. George will try and find someone from the Maine Forest Products Council as a possible replacement.

    A letter was sent on April 27, 2007, from the Secretary of State to the Governor Baldacci requesting the reappointments. We received a letter dated May 11, 2007 from Joe Boucher, Director of Boards and Commissions, thanking the Secretary of State for his recommendations, and that the Governor would give his recommendations careful consideration.

New Business:

The Board was given handouts of the latest FMCSA Motor Carrier Safety Progress Report for review, and Garry indicated the staff would continue to work on providing the board with some meaningful statistics that would give the Board and indication of the Board’s impact on improving safety.
