The Maine Motor Carrier Review Board met on March 6, 2007 to review the records of five motor carriers.


The following Board members were present:

Mark Hutchins, Chair; George Parke; Dale Hanington; Bruce Gray, Alan Quinlan; and Ron Hutchins.


BMV attendees:

Garry Hinkley, Francis Fox, Patrick Malloy, Nicole Ibarguen, and Clarissa Hurley


The December 7th, 2006 minutes were approved.


Announcements:

Garry Hinkley is officially Director of Vehicle Services. Francis Fox was promoted to Motor Carrier Chief effective March 5th. Further BMV staff changes will undoubtedly be forthcoming.


Findings:

The Ethics Code was filed and adopted.


Review of “A” carriers:

Alan Spencer, dba A &S Transport. RSR 109.8; No Action. George/Dale. Unanimous.

Alan Spencer, dba A & S Transport of Saco, Maine (USDOT#783569) is a for hire carrier of scrap metal and bottled water. The carrier operates one truck and driver. This is the first review, and is a continuation from Dec. 7th.

During the review period, the carrier had six violations (1 serious) for 22.1 points including 1 disqualified driver; 2 unsafe commercial motor vehicle; 1 defective frame; 1 operating over height; 1 failure to provide proof of commercial inspection. 20,132 Maine miles from IRP CH resulting in an RSR of 110.

There were no violations after the review period.

The carrier has a driver SEA of 74; a Vehicle SEA of 85; and is SAFESTAT category F, MCSIP step 16. ISS value of 79.

Carrier was represented by attorney Scott Gardner. Mr. Gardner presented a summary of Mr. Spencer’s steps to improve his safety compliance. Mr. Spencer also has improved his record keeping.

NCD Transport Inc, RSR 577. No Action. George/Bruce. Unanimous.

NCD Transport Inc of Totowa, NJ is a for hire carrier of general freight, operating approximately 23 trucks with 23 drivers. This is a continuation from Dec. 7th.

During the review period, the carrier had 10 violations (3 serious), including 3 falsifying logs; 1 inadequate safety device; 2 no lights on trailer; 1 no O/A license; 2 on ID device; and 1 failure to comply with IRP. Total points: 35.2. 6,100 Maine miles taken from the IRP Clearinghouse. RSR of 577.

The carrier did not have any violations after the review period. This is the carrier’s first review. The carrier is under suspension for an FTA from 2005.

The carrier has a Crash SEA of 22; a Driver SEA of 96; a Vehicle SEA of 47; and a Management SEA of 84. The carrier is SAFESTAT category B, with a MCSIP step of 12 (Targeted.)

Carrier was represented by William Hall, Safety Manager. Mr. Hall outlined the steps NCD has taken to improve their compliance with commercial driver requirements. Mr. Hall agreed to resolve his company’s FTA.

County Concrete Co Inc. RSR 48.5. No Action. George/Bruce. Unanimous.

County Concrete Co Inc of Columbia Falls is a private carrier in the construction business. The carrier operates approximately 19 trucks and drivers. This is the carrier’s second review. The carrier previously was issued a warning letter in June. Previous RSR was 33.1.

During the 18 month review period, the carrier had 20 violations (none serious) including 6 for excess vehicle weight; 1 inadequate brakes; 1 unsecured load; 4 inoperative lights; 1 operating without O/L permit; and 7 failure to provide proof of insurance. The carrier’s total points is 57.1; Maine miles is 117,696 resulting in an RSR of 48.5.

After the review period, the carrier had 10 additional convictions: 3 for expired inspection sticker; 1 for inadequate tail light; 1 for failure to display flags/flares; 2 for excess weight; 1 for failure to provide evidence of insurance; 1 for failure to comply with fuel tax licensing; and 1 for inadequate brakes.

The carrier has a vehicle SEA of 92 and is SAFESTAT category F. MCSIP score is zero (not targeted.) ISS rating is 82.

Carrier was represented by Rob Worcester, general manager. Mr. Worcester noted the company’s past vehicle maintenance problems and outlined the steps taken to address those problems. The company has new dispatch process, a new maintenance manager, and has instituted a new vehicle maintenance record system.

William A. Renaud Jr. Trucking Inc. RSR 38.0. No Action. Alan/Bruce. Unanimous.

William A. Renaud Jr. Trucking Inc. (USDOT# 309995) of South Berwick, Maine is in the business of hauling waste materials, aggregates, construction equipment and building debris primarily in southern Maine and New Hampshire. The carrier operates approximately 15 trucks with 7 drivers.

During the review period, the carrier had 11 violations (1 serious) including 1 Aggravated gross weight; 1 excess weight; 3 inadequate brakes; 1 defective frame; 1 inadequate tires; 1 defective brake adjustment; 2 expired inspections; 1 failure to display DOT#. Total of 33.8 points. 88,872 Maine miles resulting in an RSR of 38.

No known violations after the review period. There was one accident in 2005. The carrier previously was reviewed Sept. 8, 2005. Their RSR was 24.0. The result was a warning letter.

The carrier has a Vehicle SEA of 97 and a Safety Management SEA of 88. ISS value of 95 and is SAFESTAT category C with a MCSIP step of 12 (targeted.)

The carrier was represented by Dawn Brownell and William Renaud Jr. Ms. Brownell acknowledged previous vehicle defect problems, outlined the steps taken to address the carrier’s vehicle maintenance issues.

Royal Transport System Inc, RSR 577. No Action. George/Bruce. Unanimous.

Royal Transport System Inc of Elkgrove, Il. (USDOT# 1040176) is in the business of transporting general freight for-hire using approximately 68 trucks and 67 drivers, probably owner-operators. This is the carrier’s first review and is a continuation from the Dec. 7th meeting.

During the review period, the carrier had six violations (2 serious) including 2 for falsifying log books; 1 inadequate brakes; 1 defective frame; 1 operating w/out operating authority license; and 1 inadequate fire extinguisher for a total of 24.8 points. The carrier reported 8,223 Maine miles on their IFTA returns resulting in an RSR of 302.

There were no known violations after the review period.

The carrier has a Crash SEA of 58; a Driver SEA of 98; and a Vehicle SEA of 70. The carrier is SAFESTAT Category E, and has a MCSIP step of 24 (targeted.) The ISS value is 92.

Carrier was represented by Dino Krupa who participated by conference call. Mr. Krupa acknowledged that the carrier had problems related to starting a new trucking company. He noted that the company has instituted new software to track and schedule drivers and to enforce driver requirements. The committee noted that the carrier’s FMCSA scores are trending in the proper direction.


B Carriers Follow-up:

The Board heard follow up reports on Griffin’s Disposal Service, Davis Paving Inc., and S & J McCarthy Inc. Griffin’s Disposal appears to have been sold and absorbed into another company. The latter two carriers returned their supplements. There were no additional violations.
